Councilor Marlon Luz Proposes Changes to the Bill That Includes a Cap on Fees for Uber and Other Benefits for App Drivers.

And if you thought platforms like Uber could continue their old practice of charging outrageous fees of up to 50%, you can breathe a sigh of relief. The new project aims to cap this cut at 25%, ensuring more fairness in drivers’ pockets.
This Thursday (12), councilor Marlon Luz from São Paulo presented a new text for Bill 12/2024, which promises to regulate the work of app drivers throughout Brazil. The proposal was submitted to the bill’s rapporteur, Deputy Augusto Coutinho, and brings significant changes for the category.
End of App Drivers’ Unions

Among the main changes, Marlon highlights the end of app drivers’ unions, stating that they do not effectively represent the class. “Uber and other platforms will no longer be able to keep more than 25% of the fare value,” said the councilor, who also emphasized the relief for workers who are already burdened with high fees of up to 40% or 50%. “No one can take these absurd fees anymore,” he stressed.

Exemption from IPI on the Purchase of New Cars
The text proposes an exemption from the Tax on Industrialized Products (IPI) when purchasing new cars for app drivers, something that already occurs with taxi drivers. Marlon explained that this measure is fair to equalize the rights among the categories. “We are also ensuring credit with interest rates half of the market for the purchase of a new car, ” he added.
Another fundamental point is the real autonomy of drivers, which, according to Marlon, was confusing in previous proposals. Now, the new text ensures that app drivers will have more control over their activities, promoting true independence.
Uber Was Against Benefits Offered by Municipalities, According to the Councilor
The proposal also authorizes municipalities to register app drivers, which will allow city halls to offer benefits such as blue zone exemption and traffic restrictions. “Until now, Uber has taken legal action against these measures, but now municipalities will have more power to offer these benefits,” clarified the councilor.
Mandatory Toxicology Testing
Finally, Marlon Luz announced the mandatory toxicology test for app drivers. According to him, professionalization is the way to value the class. “Uber and 99 prefer amateurs because it’s cheaper for them. But when we professionalize the driver, he gains the respect and recognition he deserves,” he concluded.

Another relevant benefit was the control over earnings. Uber’s business model allowed drivers to decide how much they wanted to work and, consequently, how much they wanted to earn. During the early years, with high demand for rides, drivers had the potential to earn good income. And in parallel, Uber also offered additional incentives, such as fuel and maintenance discounts to help reduce drivers’ operational costs, in addition to reward programs like the “6 Star Club”, which provided exclusive advantages to drivers with better ratings.
