Last Tuesday, (09/04), a bill was approved by the Chamber of Deputies, marking the return of Personal Injury Insurance Caused by Vehicles Land Motor Vehicles (DPVAT). This insurance, which had been suspended in 2020 during the government of former president Jair Bolsonaro, is known for its role in supporting victims of traffic accidents throughout Brazil. Now, it is known as SPVAT.

What changed in the new Bill?

With the approval of the project, the DPVAT not only returns but also undergoes a substantial reformulation, now being redesignated as Mandatory Insurance for the Protection of Traffic Accident Victims (SPVAT).

The project, approved with a majority of 304 votes in favor against 136, now goes to the Federal Senate for analysis.

If approved without vetoes, it will implement several significant changes.

Among them, the expansion of coverage to include complementary medical expenses such as physiotherapy, medicines that are not provided by the SUS and funeral services.

These changes aim to offer broader and more appropriate support to the needs of victims of road accidents. transit and their families.

DPVAT is administered by Caixa Econômica Federal, with funds collected annually from all vehicle owners.

The amounts paid varied depending on the type of vehicle, and the amount collected was intended to compensate accident victims, regardless of responsibility for the damages.

What happens to those who don't pay the SPVAT?

One of the new features brought by the project is the penalty for vehicle owners who do not pay the SPVAT.

Failure to pay will result in a fine for a serious infraction, set at R$195,23. 

How do I apply for DPVAT?

Regarding compensation, the amount to be granted in each case will be defined by the National Private Insurance Council (CNSP).

To request compensation, it will be necessary to present a request accompanied by proof of the accident and the damage caused, or even present the death certificate or autopsy issued by the Legal Medical Institute (IML), in more serious cases.
