Case of Resident Convicted After Retaining Transfer Sent by Mistake in Benavente Exposes Legal Risks, Reinforces Importance of Immediate Return, and Guides on How to Act Correctly

The popularity of Pix has grown because the system allows money to be sent quickly using only the recipient’s cell phone number. This convenience helped the method become standard in Brazil. However, the same ease that speeds up life also opens the door to errors. A simple wrong transfer can create troubles.

According to the portal Xataka, a colleague experienced this after receiving R$ 575 from a stranger. She returned the amount immediately, but not always does the story end that way.

In Zamora, Spain, a resident of Benavente received R$ 115 by mistake and decided not to return it.

The situation was reported by the newspaper La Opinión de Zamora. The report showed that the court understood the case as embezzlement.

The man claimed that it was all a misunderstanding. Even so, he never returned the amount, despite the formal request from the woman who mistakenly sent the Pix.

According to the report, the Benavente Court analyzed the case. After that, it determined that he should return the R$ 115 and pay a fine of R$ 1,035. In addition, he was also ordered to pay court costs.

Attempts to Appeal Did Not Work

The convicted man filed an appeal. He stated that there was a lack of concrete evidence and cited the principle of the presumption of innocence. The Court of Justice assessed the allegations but decided to uphold the previous sentence.

For the judges, it was demonstrated that he knew about the error and still took no initiative to return the amount. The insistence on keeping the money reinforced the court’s understanding.

Consequences of Keeping Undue Amounts

Cases like this show that keeping a deposit received by mistake can lead to serious problems. Even small amounts can result in lawsuits and fines.
