ANP Approved Action Plan on Tariffs and the Return Rate of Natural Gas Production, Establishing Rules for the 2026-2030 Cycle and Opening New Public Consultation

The production of natural gas in Brazil has taken new directions with the recent decision of the National Agency of Petroleum, Natural Gas and Biofuels (ANP), announced on November 6, regarding the Action Plan for the Regulatory Cycle 2026-2030, according to a report published.

The measure defines the methodologies and parameters that will guide the transportation tariffs in pipelines, directly impacting transport companies, investors, and the national energy sector.

Additionally, the ANP opened a new public consultation to review the return rate applied to transport companies, a fundamental step in compensating investments in gas infrastructure.

This move reinforces the search for greater transparency and economic balance in the formation of tariffs.

Between August 25 and October 8, 2025, the ANP received contributions during Public Consultation No. 8/2025, where five transport companies presented their tariff proposals.

Based on the feedback and technical analyses, the Agency decided to develop a plan divided into phases to deepen the debate and build more robust methodologies.

Tariff Planning and Public Consultation on Return Rate

The first stage of the Action Plan focuses on defining the return rate, an index that determines the financial gain of transport companies on the capital invested in their pipelines.

The expectation is to complete this phase by December 2025. The ANP also approved the opening of a new 15-day public consultation, aimed at discussing criteria and improving the methodology in effect since 2019.

According to the Agency, the update seeks to align the regulatory model with the transformations of the Brazilian capital market and best international practices.

The goal is to ensure that the transporter operates efficiently and receives fair compensation for the assets included in the Regulatory Asset Base (BRA).

This stage will be essential to establish a solid foundation for future decisions regarding transportation tariffs for natural gas production, ensuring predictability and stability for the sector.

Valuation of the Regulatory Base and Definition of the Maximum Allowed Revenue

The second phase of the plan, scheduled for February 2026, will address the valuation of the Regulatory Asset Base (BRA), which is the set of assets and facilities directly related to the transportation activity.

This valuation is crucial to determine the amount that companies can recover through tariffs.

The third phase, scheduled for May 2026, will address the Maximum Allowed Revenue (RMP), which represents the ceiling of remuneration that transport companies can receive for the services provided.

During the transition, the ANP determined the use of extraordinary contracts. These instruments allow transport companies to offer available capacity temporarily, following the short-term contracting process.

This measure aims to avoid interruptions in operations and ensure continuous supply until the definitive approval of the new tariffs and the RMP.

These contracts will have limited validity and will be automatically terminated upon the completion of the annual Capacity Offering Process (POCC).

Regulatory Impacts and Security in the Transportation of Natural Gas Production

The new regulatory plan from ANP aims to establish a more stable environment for investments in natural gas production and transportation in pipelines.

The three-phase structure creates a logical sequence of analysis, from the return rate to the definition of tariffs, strengthening legal security and predictability for companies and consumers.

With the revised return rate and improved methodology, a more realistic valuation of assets and a fair distribution of costs are expected.

Furthermore, the introduction of extraordinary contracts represents a practical solution to the complexity of the regulatory process, avoiding contractual gaps and maintaining the national energy flow.

By aligning the plan with recent market transformations and modern regulatory practices, the ANP reinforces its commitment to economic sustainability and competitive development in the gas sector.

Thus, the 2026-2030 cycle is set to consolidate an important framework for the transportation and production of natural gas in Brazil, with greater transparency and security for all stakeholders involved.
