Passing in a prohibited place can result in a very serious violation, with 7 points on the CNH and a fine that can reach US$ 2,934.70 in case of recidivism within 12 months.

The Article 203 of the Brazilian Traffic Code determines when the maneuver in the opposite lane becomes a violation and applies a multiplier of five on the base amount of the very serious violation.

The yellow signaling on the pavement is the main warning of when passing is prohibited.

What Does Article 203 of the CTB Say

The legislation defines passing as the maneuver of overtaking another vehicle using the opposite lane.

The CTB does not prohibit all passing, but expressly restricts situations where safety is compromised.

Article 203 characterizes the infraction of passing in the opposite lane at critical points:

  • Curves, inclines, and declines with insufficient visibility
  • Crosswalks
  • Bridges, viaducts, and tunnels
  • Stopped queues next to traffic lights, gates, barriers, intersections, or any other obstruction to free movement
  • Sections with a continuous double line or simple continuous yellow line

How the Fine and Scoring Work

The very serious violation has a base value of US$ 293.47.

When the conduct is as provided in Article 203, a multiplier factor of five is applied, bringing the fine to US$ 1,467.35.

In recidivism within 12 months, the penalty is doubled, reaching US$ 2,934.70.

The infraction adds 7 points to the National Driver’s License (CNH), which can accelerate reaching the limit for suspension of the right to drive.

Prohibited Passing: When the Maneuver Cannot Occur

Not every road provides conditions to cross the center line.

In curves, visibility ahead is blocked. In inclines and declines, distance assessment is hindered in bridges, viaducts, and tunnels, and there is no escape area.

On crosswalks, the priority is for the pedestrian.

In stopped queues next to traffic lights, barriers, or intersections, the opposite lane creates an immediate risk of head-on collision and run-over.

In these sections, passing in the opposite lane directly falls under Article 203.

Yellow Stripe: What Each Design Indicates

The yellow marking on the edge of the road separates flows in opposite directions and guides the driver on when it is possible or prohibited to use the opposite lane.

When the line is simple dashed, passing is generally permitted in both directions, as long as visibility and road conditions are favorable.

In the dashed/solid combination, the maneuver is only allowed on the dashed line side.

Those on the side of the solid line must remain in their lane.

On the simple solid line, the maneuver is prohibited in any direction in that section.

On the double solid line, the prohibition is reciprocal, common in wide roads or in segments with high risk.

When the Opposite Lane is Authorized

Although the general rule is to drive in the correct direction of the road, there are legal exceptions.

Passing can use the opposite lane when signaling allows and there are safe conditions of distance, time, and visibility.

Situations of construction or road closures may require temporary circulation on the opposite side, according to guidance from the traffic authority or agent.

Additionally, emergency vehicles, such as ambulances and fire trucks, may travel in the opposite direction while responding, with sound and light devices activated.

Safety Before the Maneuver: Scenario Reading

Before deciding to pass, the driver needs to assess three essential factors.

First, horizontal and vertical signaling: the presence of a solid yellow line or prohibition signs eliminates the possibility of maneuvering.

Next, visibility: sections with curves, hilltops, or depressions conceal approaching vehicles and make distance calculations imprecise.

Finally, the traffic dynamics: speed differences between vehicles, the presence of side accesses, crosswalks, and intersections weigh against the attempt to cross the center line.

Fines by Nature of the Infraction

The CTB classifies infractions as light, medium, serious, and very serious.

The base amounts are:

  • Light: US$ 88.38
  • Medium: US$ 130.16
  • Serious: US$ 195.23
  • Very Serious: US$ 293.47

In specific cases, such as the prohibited passing under Article 203, the law authorizes multipliers that raise the total amount, reflecting the high risk potential of the conduct.

Why the Yellow Stripe Matters So Much in Framing

The horizontal signaling for flow division is designed to communicate, immediately, the safety of the section.

In places with a solid line, traffic engineering has already identified that passing allows no margin for error.

Ignoring this warning turns the maneuver into a frontal displacement in the conflict zone, increasing the likelihood of serious collisions.

For this reason, the law treats the conduct as very serious with a multiplier, not out of formality, but due to evident risk.

What to Do When Encountering Critical Sections

If the road displays a solid line or conditions are unfavorable, the guidance is to postpone passing and maintain safe distance from the vehicle ahead.

When a segment with a dashed line appears, the maneuver should be planned in advance.

It is necessary to check mirrors, signal in advance, ensure there is time and space to merge and return to the original lane, and to give up in case of any uncertainty.

On single-lane roads, additional caution is essential, as miscalculating can result in confrontation with oncoming traffic.
