Public Manifesto Released in September 2025 Highlights Budgetary Threat and Institutional Risks to Brazilian Autarchies
The National Academy of Engineering (ANE) released, on September 10, 2025, a manifesto in defense of the technical and budgetary autonomy of Brazilian regulatory agencies. The document emerges amid the processing of the Proposed Amendment to the Constitution (PEC) No. 42/2024, which, according to the entity, represents a serious institutional setback.
Budget Cuts Compromise Strategic Action
According to the ANE, regulatory agencies were designed as state structures. The aim is to ensure regulatory stability, economic balance, and protection of society.
However, in recent years, budget cuts exceeding 30% have been applied, even to institutions that have their own revenue and high income.

According to the academy, this situation undermines efficient oversight, weakens institutional functioning, and hinders the full exercise of regulatory responsibilities.
PEC 42/2024 Puts Technical Independence at Risk
Under analysis in the National Congress since July 2024, the PEC No. 42/2024 proposes the removal of the decision-making autonomy of the agencies.
The ANE emphasizes that approval would weaken the strategic role of these institutions. Furthermore, it could affect the confidence of national and international investors.
At the same time, the academy highlights that the measure threatens economic predictability. Therefore, it puts at risk the protection of consumers and the regulation of essential sectors.
Support for Parliamentary Initiatives
To block the PEC, the ANE declared full support for two parliamentary measures presented in September 2025.
- Deputy Arnaldo Jardim (Cidadania-SP): proposed the inclusion of the budgetary autonomy of the agencies in the Budget Guidelines Law (LDO).
- Deputy Alencar Santana (PT-SP): voted for the unconstitutionality of PEC No. 42/2024, recommending its rejection in the Committee on Constitution and Justice and Citizenship (CCJC).
These actions, according to the entity, are essential to ensure legal security and preserve the regulatory independence.

Founded in 1991, the ANE is a private, non-profit association of a technical-scientific and cultural nature.
According to the statement, the institution understands that engineering, science, and technology, guided by high ethical standards, are indispensable for national sovereignty and sustainable development.
In this way, the academy’s position reaffirms its commitment to the interests of Brazilian society. At the same time, it defends the independence of regulatory agencies as a pillar of economic advancement and institutional security.
Autonomy as a Guarantee of the Future
The ANE concludes that the loss of autonomy would compromise the balance between economic agents and citizen protection. This would directly affect infrastructure and public service sectors.
Moreover, the manifesto warns that the weakening of the agencies may generate legal insecurity. This would reduce Brazil’s competitiveness and hinder the attraction of long-term investments.
