The Finance and Taxation Committee Approved Bill 451/24, Which Amends the Brazilian Traffic Code to Allow Installments of Fines for Drivers with Disabilities, with Specific Rules, Requirement for Interstate Agreements, and Direct Impact on Default with Traffic Agencies

The Finance and Taxation Committee of the Chamber of Deputies approved Bill 451/24, which creates the installment plan for traffic fines for drivers with disabilities, amends the Brazilian Traffic Code, and establishes specific rules for infractions occurring outside the state of registration.

The approved proposal allows the installment of traffic fines for drivers with disabilities and for those responsible for individuals with disabilities, maintaining the obligation to fully settle the penalties provided by the traffic legislation.

The text defines that when the vehicle is registered in another state, the installment of traffic fines will only apply if there is an agreement between the traffic agencies of the state of registration and the state of the infraction.

The matter was authored by Deputy Duda Ramos and amends provisions of the Brazilian Traffic Code to create differentiated treatment for drivers benefiting from the measure, without eliminating the administrative sanctions applied.

The report in the Finance and Taxation Committee was by Deputy Dayany Bittencourt, who recommended the approval of the text along with previously made amendments in the Committee on Transportation and Traffic.

According to the rapporteur, drivers with disabilities often have their income impacted by the high penalty amounts, and the installment of traffic fines creates a less burdensome payment method, preserving the fulfillment of legal obligations.

Dayany also assessed that the measure can help reduce default with traffic agencies by facilitating the regular payment of imposed fines, without dismissing the accountability of the offender.

Amendment

During the analysis, the rapporteur modified the original wording to replace the expression “without monetary increase of any nature” with “with favorable conditions,” seeking balance between social benefit and fiscal prudence.

According to Dayany, the change maintains the installment of traffic fines as a mandatory rule for beneficiaries, ensuring differentiated treatment relative to general rules, with greater practical viability.

Next Steps

The project will still be analyzed, in a conclusive manner, by the Committee on Constitution, Justice, and Citizenship, and to become law it needs to be approved by the Chamber and the Senate, fulfilling all stages of the legislative process.
