New Labor Law Promises To Change CLT With 10 Days Off And Extra Salary. Understand How The Change Can Impact The Lives Of Brazilian Workers In 2025.

In the year 2025, Brazilian workers governed by the CLT will benefit from significant advancements in their labor rights, resulting from substantial changes in legislation. Among the main measures in force, the extension of paternity leave to 20 days stands out, guaranteed by the Civic Business Program, regulated by Law 13.257/2016, which aims to allow greater participation of fathers in the first days of their children’s lives. In addition, the right to double payment or compensatory time off for those who work on holidays remains assured by Law 605/1949, reinforcing the appreciation of workers’ efforts on these dates. Another highlighted topic is the proposed reduction of the weekly working hours, currently being debated in the National Congress through projects like the new law of PL 1.652/2021, which seeks to provide a better balance between professional and personal life.

Although still not approved, the debate points to future advancements in labor conditions in the country. This article details these changes and discusses the concessions that remain valid in 2025, strengthening the rights of Brazilian workers.

Understand The New Labor Law That Will Bring 10 Days Off And Extra Salary

For those who do not know, the Consolidation of Labor Laws (CLT) has existed since the 1940s. Since then, the regulations have undergone several modifications and adapted to the reality of each era. Currently, the IBGE revealed that 38 million citizens are working with formal registration in the country. Conversely, another part is still engaged in complementary functions or services.

The rules serve to safeguard the well-being of the employee and the seriousness of employers who depend on their workers. Among the main issues are vacations, safety standards, working hours, and various other topics. One of them is related to paternity leave.

In general, the Federal Constitution provides for a 5-day leave after the child’s birth. However, if the company is registered in the Civic Business Program, the period will be extended by an additional 15 days, totaling 20, without salary deductions for Brazilian workers.

With the new labor law, the employee can also opt for 10 days off and extra salary, meaning full salary for 10 days and half of the paternity salary for the other 10, potentially securing extra money in their account. There is also the possibility of negotiation with the employer, allowing for discussions on new conditions regarding the period in question.

It is important to mention that the rules of the CLT for Brazilian workers include minimum wage, vacation allowances, maternity and paternity leave, unemployment insurance, FGTS, transportation vouchers, overtime, additional night values, work schedules, among others.

It is worth mentioning that, in addition to the new labor law with 10 days off and extra salary, there are other ongoing discussions, such as the proposal to eliminate work for 6 days a week, raised by federal representative Erika Hilton from PSol. Among the issues raised are well-being and quality of life in the labor market.

With a possible change in the CLT, there would be greater balance between professional and personal routines, more focus on health and family relationships, as well as greater opportunities to enhance qualifications. For now, the new topics are still under discussion for inclusion in the agenda.

Changes Expected In The New Law In 2025

The new guidelines proposed for the Consolidation of Labor Laws (CLT), under analysis by the Federal Government for 2025, suggest changes that could transform the work routine by limiting work on Sundays and holidays for Brazilian workers.

The measure, if approved, will condition this practice only upon collective agreements between companies and employees, aiming to ensure fair and beneficial negotiations for both sides.

The goal, as stated, is to guarantee Brazilian workers a healthy balance between personal and professional life. The proposal has sparked heated debates among labor unions and business sectors. Unions view the changes as a crucial step towards ensuring more dignified working conditions, while business owners warn of possible impacts on competitiveness and employment.

The discussion poses significant economic challenges for companies. The need to formalize collective agreements may increase costs with legal advice and union negotiations, along with requiring payment of additional fees and overtime for work on these days.

Alto número de pessoas que não duram um ano na empresa por ficar dando atestado para forçar o empregador a mandar embora, receber os direitos para aproveitar uns dias com um dinheirinho e depois procurar trampo.
