Law 15.108/2025 Equates Stepchildren, Minors Under Guardianship and Custody to Children for the Purpose of INSS Pension, Just Declare and Prove Dependence.
On March 13, 2025, Law 15.108/2025 was enacted, which amends § 2 of Article 16 of Law 8.213/1991. Thus, the law now equates stepchildren, minors under guardianship, and minors under judicial custody to children for social security purposes. This right depends on two requirements: a formal declaration from the insured and proof that the minor does not have sufficient means to support themselves or cover their own education.
This change addresses a gap: until now, the law already provided for stepchildren and minors under guardianship to be equated to children, but explicitly excluded minors under judicial custody. The new wording restores the status of dependents to minors under custody.

These requirements aim to prevent fraud or misuse of the law, ensuring that the benefit truly reaches vulnerable dependents.
Which Benefits Become Accessible
With the legal equivalence of dependents, minors who were previously excluded can now claim benefits such as:
- Death Pension – in the event of the insured’s death, the minor under custody, guardianship, or stepchild can receive a pension as if they were a child.
- Incarceration Assistance – a benefit that previously considered social security dependents now also includes these equated minors.
- Other rights that depend on social security dependency may be reasonably applied in the same way.
The government has already announced that the INSS recognizes that “minor under custody is equated to a child” for the purpose of social security benefits, in accordance with changes in the law.
Practical Consequences and Legal Challenges
This law changes the dependency landscape in the general social security system. Many legal cases may be revised, and new demands will arise. Families caring for grandchildren, nephews, or minors previously excluded gain greater legal support to claim pensions.
However, there are challenges:
- It is necessary for the custody to be judicially formalized. Informal custody may not be accepted administratively.
- The declaration and proof greatly depend on properly gathering guardianship or custody documentation and evidence of economic dependence.
- In already closed cases, it will be necessary to initiate review processes or new actions to recognize the right.

É uma lástima ver alguém com um pensamento tão ardil , acontece camarada que não pode generalizar chamando os pais se irresponsáveis, a vida das pessoas da muitas voltas e muitos casais que tiveram filhos durante um período de estabilidade financeira podem de repente ir a bancarrota, podem adoecer, podem morrer, enfim uma série de eventos que levam milhares de crianças a uma situacao muitas vezes de miséria total, o que deve ser combatido é a corrupção afinal de contas TRATA-SE DE PREVIDÊNCIA SOCIAL.
Exatamente! A Previdência é para essa finalidade! Quem contribui espera o amparo de uma aposentadoria e pensão para garantir a dignidade de seus dependentes legais. O q deve ser cuidado são os “ralos”, que deixam **** fazerem escoar os recursos pagos pelos contribuintes. E a tal da DRU(desvinculação das receitas da União), que transformou os recursos arrecadados pela Previdência Social, num grande saco, onde governo e congressistas metem as mãos! Além disso, as renúncias fiscais, para beneficiar grupos de empresários, como a “desoneração da folha”! Empresários se apropriam de valores que deveriam estar indo para a Previdência! E qdo o dinheiro escasseia, quem paga é o trabalhador que contribui e vê, cada vez, mais distante o sonho de uma aposentadoria!

Não acho justo sou aposentado, minha esposa está a anos em análise para aposentar. Caso ela cobsigz aposentar ainda viva .C um de nós morrer um de nós terá que abrir mão do benefício. Até parece que o Brasil é uma nação rica pra tantos benefícios .Afinal essas bondades sairá do próprio contribuinte.
Quem cortou benefícios foi a última reforma da previdência, feita pelo governo do Bolsonaro, que cortou a possibilidade de pessoas, casadas, que trabalharam — de ombro a ombro — e contribuíram, igualmente, para aprevidência, levar a pensão do cônjuge querido. Ora, se os dois trabalharam e contribuíram, por que o cônjuge q tem uma aposentadoria não pode receber a pensão do que se foi(e contribuiu)! É um abuso e um confisco!
