The Goal of Changing the Regulations Is to Reduce Bureaucracy and Encourage Entrepreneurship, and It Is Estimated a Savings of R$ 43 Billion for Companies in the Next 10 Years

Click Petroleum and Gas Had Already Announced in May That the Government Would Review the Regulatory Norms, indeed, at a ceremony last Tuesday (07/30) at the Palácio do Planalto, the government announced the long-promised change in the Regulatory Norms for Health and Safety at Work.
Present were the President of the Republic, Jair Bolsonaro, the Vice President, Hamilton Mourão, the Minister of Economy, Paulo Guedes, the Chief Minister of the Civil House, Onyx Lorenzoni, and the Special Secretary of Social Security and Labor, Rogério Marinho.

According to Rogério Marinho, the 36 norms will be analyzed and, if necessary, amended to reduce bureaucracy and encourage entrepreneurship.
“We cannot coexist with anachronistic, bizarre rules that delay us, hinder us, and inhibit us. We cannot continue to be a factory of obstacles for those who want to undertake in this country”, said the secretary.

The Changes

The modifications to the regulatory norms will be made in stages, and in this first phase, Regulatory Norms 1 and 12 were amended, and Regulatory Norm 2 was revoked.

The amendment of NR 1 addresses the reuse of training conducted by workers for use in other companies within a two-year period, and the removal of the requirement for micro and small businesses with very low or low risk levels to develop Environmental Risk Prevention Programs (PPRA) and Occupational Health Medical Control Programs (PCMSO).

NR 12 proposes measures that protect and ensure the health and physical integrity of workers who handle, install, and operate machines and equipment.

Regulatory Norm 2, which was revoked, required a prior inspection by a federal regulatory body on the facilities of new establishments, which means it will reduce state interference in private initiative.

The Federal Government estimates that the changes in the regulatory norms will generate savings of R$ 2 billion in two years with NR1 and savings of R$ 43 billion in 10 years for the industrial sector.

President Jair Bolsonaro stated that the deregulation of the norms will favor entrepreneurship.
“I believe we should have 100% faith in the entrepreneur. How? By removing these norms. This excess of regulation leads to the paralysis of the economy. And we were, indeed, becoming more and more stuck and paralyzed. And we had to change that. These norms, or the repeal of these norms, improvements, are very welcome. And this, yes, can unlock our economy and lead us on the path to prosperity”, said the President of the Republic.

The work of analyzing and amending the regulatory norms will continue in the coming months, and other modifications are expected to be announced by the government as soon as they are completed.
The rules must be followed by companies with employees governed by the CLT. The changes do not require congressional approval and come into effect in 45 days.
