In addition, some infractions were recorded by photo-sensor equipment that, until the end of June 2000, were not properly calibrated by the National Institute of Metrology, Quality and Technology (Inmetro).
This means that, besides the lack of notification, there were issues with the calibration of the equipment that recorded these infractions.
Million-Dollar Settlement
The settlement between the Public Prosecutor’s Office of Rio Grande do Norte and the State was approved by the 3rd Public Finance Court of the District of Natal.
According to the approved agreement, the State Department of Traffic of RN (Detran/RN) will be responsible for preparing and publishing a notice calling all vehicle owners, including cars from brands like Chevrolet, Ford, and Toyota, that have the right to reimbursement.
The total amount of fines, already updated, exceeds R$ 30 million, according to 2022 data. In an official statement, Detran announced it will take all necessary measures to comply with the Agreement Term within the established deadlines.
What Does This Settlement Mean for Drivers?
The agreement between the parties ends a legal demand that lasted over 25 years. Drivers who were fined will be notified through a communication informing them that the refund will be made with a 40% discount on the original fine amount. The notice for reimbursement will be published within 30 days.
After the publication of the notice, Detran/RN will conduct a registration of interested drivers on the service portal, which will take place over 90 days.
This registration period will allow users to request the reimbursement. After this phase, Detran/RN will have an additional 90 days to screen the requests and process the refunds, which will take place between March 1 and May 31, 2025.
