In Dispute That Exposes Gaps About Common Law Marriage And Asset Sharing, The Justice Of Alagoas Maintained The Blockage Of 50% Of The Prize Of R$ 103 Million While It Analyzes The Merit; The Winner Of The Mega-Sena Challenges And Argues That The Bet Was Individual And Prior To The Marriage.

The winner of the Mega-Sena who received R$ 103 million in October 2020 faces a legal battle initiated by her ex-partner. He claims that they were living in common law marriage at the time of the draw and that he even participated in choosing the numbers. She counters, saying that they were only engaged when she placed the bet, which won the drawing days before the wedding and that the prize does not belong to a common property.

The case took a new turn when, in December 2023, a 50% blockage of the amount was ordered. The precautionary measure, according to the decision, would serve to ensure enforcement if the ex’s thesis prevailed in the end. R$ 22.5 million linked to the winner were found; 10% of this amount was released in February 2024. Since then, the legal discussion has focused on the recognition or non-recognition of the common law marriage prior to the wedding.

What Is At Stake In The Justice System

The ex-partner claims to have the right to half of the prize and also requests compensation for moral and material damages, claims that bring the dispute closer to R$ 66 million.

Besides the argument of public and continuous cohabitation, he claims to have helped choose the numbers of the winning bet, a thesis denied by the winner of the Mega-Sena.

The winner states that she placed the bet alone, that there was no common law marriage at the time of the drawing, and that the wedding happened later.

She points out that the separation that occurred about nine months after the marriage was due to rudeness and mistreatment.

She also reports having given R$ 10 million to the ex and R$ 1 million to each of his children at first, but that new demands led the dispute to court.

Timeline Of The Process

In December 2023, the precautionary decision to block 50% of the prize was issued, taking effect over the R$ 22.5 million located.

In February 2024, 10% of this amount was released, while the remainder remained withheld until the merit was defined.

In February 2025, the first decision favorable to the winner was reached, with the Court of Justice of Alagoas rejecting the recognition of common law marriage prior to the wedding and ordering the ex to pay attorney’s fees.

The ex appealed, which led, in July 2025, to the maintenance of the blockage to ensure the value of the case during the appeals process.

In the current scenario, the winner of the Mega-Sena continues to work as an entrepreneur, but assets remain withheld until the final judgment.

The central point to be judged is the validity of any common law marriage prior to the wedding, which determines the community or exclusivity of the prize.

Why Common Law Marriage Is Decisive

The controversy revolves around the moment of acquisition of the asset and the nature of the bond between the parties.

In such disputes, the courts assess publicity of the relationship, continuity, intention to form a family, and documentary and testimonial evidence.

If there is recognized common law marriage, assets and values acquired during its duration, as a rule, can be communicable.

If not, the prize is treated as the private property of the winner of the Mega-Sena.

The procedural discussion also justifies precautionary measures such as partial blockage, used to prevent dilapidation of assets while justice decides.

It is not a final sentence, but a preservation mechanism until the final judgment.

Financial And Processual Impacts

For the winner of the Mega-Sena, the blockage restricts liquidity and asset planning, even with an initial favorable merit decision.

For the ex, the maintenance of the restraint represents a guarantee of eventual execution if he succeeds on appeal.

From a legal standpoint, the case highlights the importance of robust evidence regarding the date and circumstances of the relationship.

The difference between engagement and common law marriage is not merely formal; it involves facts and evidence about shared living that can redefine the ownership of the prize.

What To Observe From Here On

Pay attention to three fronts. First, the outcome of the appeal that contests the favorable decision to the winner regarding the non-existence of common law marriage.

Second, possible new precautionary decisions that alter the extent of the blockage.

Third, the eventual conciliation or partial agreement, always possible in disputes of high complexity and high value, especially when maintaining the litigation immobilizes assets for a long time.

In the meantime, the winner of the Mega-Sena remains under a regime of assets affected by a court decision, and the ex awaits the final judgment of his claims.

Until then, the logic of procedural security prevails: the value in dispute is preserved to avoid irreversibility.
