A simple backpack, given as a gift by the company during the holiday season, turned into a true nightmare for an employee.

The 17th Panel of the Regional Labor Court of the 2nd Region in São Paulo decided to uphold the just cause dismissal of an employee who hung a backpack, a Christmas gift from the company, over a trash can at his workplace.

The court’s understanding took into account the employee’s history of disciplinary warnings and considered the act as a direct offense to the company’s honor.

According to information from the proceedings, the worker acknowledged that he hung the backpack on the trash can as a sign of dissatisfaction with the gift he received.

The act, which was recorded on video, had the confirmation of a witness who was present at the scene.

In his defense, the employee argued that the dismissal was unfair, as he had never been formally warned.

However, the company presented evidence that contradicted this claim, demonstrating that the worker had already received notifications for unjustified absences and delays.

Furthermore, there were records of a previous incident where the employee attempted to access a restricted area, which was also filmed and documented.

Analysis Of The Employee’s Conduct

The company made it clear that the problem did not lie in the disposal of the backpack, but rather in the act of exposing it disrespectfully over the trash can.

This attitude was interpreted as a public manifestation of discontent, something that violates the principles of respect and good coexistence in the corporate environment.

According to witness testimonies, the employee used to openly criticize the company, including negative comments in WhatsApp groups, which aggravated his situation.

Judge Débora Cristina Rios Fittipaldi Federighi was responsible for reporting the case and concluded that the evidence presented by the employer was sufficient to prove the employee’s disrespect.

The court reinforced that the employee’s behavior violated the principles of good faith, which are essential for any employment relationship.

This decision not only confirms the employee’s dismissal but also serves as a warning for other workers.
