After An Error In The Banco Safra System, Entrepreneur May Be Sued For Misappropriation And Money Laundering

A man from Goiânia (GO), owner of a restaurant, found himself in a major financial mess after receiving, by mistake, R$ 18 million in his bank account linked to the company Estevam Carnes Nobres e Exóticas Eireli, according to the Uol website. Following the unexpected amount, the entrepreneur decided to purchase a Porsche valued at R$ 280 thousand according to the Fipe table. However, the car ended up being seized by court order, and the man may be held liable for misappropriation and money laundering.

The Error Of Banco Safra And The Suspicious Transactions

According to investigations by the Civil Police, a failure in the system of Banco Safra S.A. between December 26 and 27, 2018 resulted in a deposit of the million-dollar amount into the account of Guilherme Moreira, who is 27 years old. In addition to the purchase of the luxury car, he made five transfers totaling R$ 1.1 million, which were subsequently blocked. The transactions were considered suspicious since Moreira had only R$ 27 thousand in the account prior to the incident.

The delegate Kleber Toledo, responsible for the investigation, stated: “It has been demonstrated that he misappropriated these amounts, trying to give them a lawful appearance. The Defense Of The Entrepreneur

Guilherme Moreira’s defense argues that there was no misappropriation and that it is a “legal mistake.” According to them, the error was caused by the bank’s failure to provide services, which blocked all of the entrepreneur’s accounts, hindering the immediate return of the amounts. The defense also informed that in January, Moreira attempted to negotiate with Banco Safra to return the funds, but did not reach an agreement.

The situation led to the seizure of the Porsche and a search and seizure warrant executed last week. Investigations continue, and the inquiry is expected to be sent to court soon, with penalties that may reach 11 years in prison. The refund of this amount was made four days after the error. This case raises questions about the ethics and responsibility we have when faced with money that does not belong to us.

According to Febraban (Brazilian Federation of Banks), in the case of a deposit made by mistake, the account holder should contact the bank and, if possible, the party that made the deposit to communicate the operation. The federation emphasizes that when the error is identified, the bank itself should perform the refund. If the money has already been spent, as in the case of the Porsche, there may be room for legal actions against the account holder.

Additionally, it is important for people to be aware of their responsibility when dealing with amounts deposited by mistake. Brazilian legislation provides that in such situations, the individual must act in good faith and return the amounts as soon as they become aware of the error. This not only avoids legal complications but also demonstrates an ethical commitment.
