The Chamber of Deputies is discussing a bill that radically changes how retirees and pensioners can take out credit. According to the rapporteur, Congressman Danilo Forte (União-CE), the new rules from the Central Bank will restrict payroll deductions to officially supervised financial institutions only.
The goal is to protect INSS beneficiaries from abusive practices, automatic charges, and fraud related to associations and companies without proper oversight. In practice, only payroll loans made by banks authorized by the Central Bank, with biometric verification and electronic signatures, will remain valid.

The new rules from the Central Bank directly affect retirees, pensioners, and workers who use payroll loans as their main form of financing. The rapporteur made it clear that deductions for membership fees of associations, unions, or funeral plans can no longer be automatic, and must be paid via boleto or other traditional means.

According to Danilo Forte, the measure does not represent a crackdown on union or associative entities. “The system is full of loopholes, and many retirees end up being victims of undue charges,” said the congressman to Estadão.
Why Payroll Loans Will Be Preserved
Payroll loans will continue to be allowed because, according to the rapporteur, they offer the lowest interest rates in the market. The new rules from the Central Bank seek to ensure that this type of contract is signed only in institutions with strict supervision, preventing fintechs and companies without regulation from invading beneficiaries’ accounts.
Biometric verification and digital life proof will be mandatory to release new contracts, increasing the security of the process and reducing fraud risks.
What Happens to Unions and Associations
One of the controversial points of the bill is the impact on unions and associations, which traditionally used payroll deductions to collect membership fees. With the new rules from the Central Bank, these entities will have to shift to billing systems via boleto.
For the rapporteur, this change is necessary to moralize the system: “It is not about making correct unions unviable, but about preventing fraudulent associations from taking money from retirees”, he affirmed.
Measures Against Fraud and Stricter Penalties
The bill also includes stricter penalties for fraud against retirees, including increased penalties in the Penal Code and immediate confiscation of assets from those involved. According to Forte, the idea is for the recovered funds to be used for compensating the victims.
Additionally, the Ministry of Social Security will carry out active searches to identify potential fraudsters. The State will also assume responsibility for refunding amounts, in case the beneficiary has been harmed.
The new rules from the Central Bank represent an attempt to balance access to credit with the protection of INSS beneficiaries. The proposal aims to reduce abuses, prevent fraud, and ensure greater transparency in payroll loan contracts.

Na hora de fazer o empréstimo não tinha reclamação ne. Sai pegando dinheiro e não quer desconto.
Acho que vai limitar a livre concorrência os bancos tradicionais oferece menos opções que as fintcs.
