Government Allows Classes With Independent Instructors and Expands Access to Driver’s License

The proposal from the Ministry of Transport, presented in October 2025, is in public consultation until November 2.
It aims to revolutionize the process of obtaining a National Driver’s License (CNH) across the country.
Moreover, the initiative will allow practical classes to be taught by autonomous instructors, without the obligation of a connection to driving schools.
Consequently, the measure is expected to increase access to driver training and generate new job opportunities for professionals in the sector.

Training and Accreditation of Instructors

To operate legally, the candidate must meet basic requirements defined by Senatran before starting the specific training course.
The course will be free and available on the site of the National Traffic Department (Senatran), as announced by the Ministry on October 10, 2025.
During the training, participants will learn about legislation, teaching techniques, and defensive driving, as well as take a final assessment.
After approval, the professional will receive a certificate of completion and can apply for a Professional Identification Card.
Shortly after, the instructor will need to obtain authorization from the state traffic department to perform the function.
As a result, the name of the authorized professional will be registered with the Ministry of Transport, allowing public consultation about their compliance on official websites.

How Practical Classes Will Work

The vehicles used in the classes, whether belonging to the student or the instructor, must comply with safety regulations of the Brazilian Traffic Code (CTB).
This includes the requirement for identification as a teaching vehicle and age limits for the fleet.
Additionally, during classes, the autonomous instructor must ensure that the student follows mobility rules and respects safety conditions.
At the same time, the professional will provide continuous feedback on the student’s performance, reinforcing learning.
The record of each class will be done electronically by the instructor themselves, bringing more control and transparency.
In this way, the activities will be validated according to the standards set by the state traffic department, proving the student’s participation.

Models of Operation and Professional Autonomy

One of the most significant labor advancements brought by the proposal is the possibility for professionals to operate independently, organizing and managing their own businesses.
Thanks to this flexibility, instructors will be able to choose multiple forms of contracting, as long as they comply with official regulations.
Those already working in driving schools may continue normally, balancing the contracted function with the new autonomous model.
This transition will provide more freedom, competitiveness, and income opportunities within the sector.
Additionally, the model seeks to expand access to driving education without compromising the quality of driver training.

Inspection and Legal Requirements

During practical classes, the instructor must carry mandatory documents such as valid CNH, instructor credential, Vehicle Learning License, and Vehicle Registration and Licensing Certificate (CRLV).
At the same time, traffic authorities may conduct inspections at any time to ensure compliance with regulations.
In this manner, Senatran and the state traffic department will be responsible for verifying the operation of professionals and maintaining an up-to-date national database of accredited instructors.
These measures will ensure security, trust, and transparency throughout the training process.

Public Participation and Next Steps

The project is open to public consultation until November 2, 2025, through the Participa + Brasil platform.
According to the Ministry of Transport, more than 20,000 contributions have already been registered.
Immediately after the consultation closes, the proposal will be analyzed by the National Traffic Council (Contran).
Then, the body will decide on the definitive implementation and any necessary adjustments.
According to the national traffic secretary, Adrualdo Catão, the goal is to democratize access to CNH, reduce costs, and ensure traffic safety.
Thus, driver education will become more accessible, modern, and fair throughout the national territory.

Impact and Expectations

If approved, the initiative will represent a historic change in the process of driver training in Brazil.
It will make education more accessible, flexible, and aligned with the new demands of the labor market.
However, it is important to remember that the measure is not yet in effect, which requires attention from interested parties.
Until the completion of the analysis process, all driving lessons will continue to be conducted by accredited driving schools, as determined by Contran.
With the public debate ongoing, the project points to a new horizon in the Brazilian traffic sector.
Furthermore, the proposal combines technology, professional autonomy, and modernization of mobility policies, transforming the way people learn to drive in the country.
