In a decision reported on December 11, 2025, the judge of the 2nd Special Civil Court and Consumer Relations of São Luís concluded that Apple is not required to sell iPhone with charger. The magistrate rejected the consumer’s requests for compensation and reimbursement of the amount spent on a power adapter purchased after the phone was bought.
The case began after the customer realized that the newly purchased iPhone did not come with a wall charger. He claimed that the smartphone became unusable since it lacked a compatible adapter for the new USB Type C port and stated that he was forced to purchase an original adapter from the manufacturer, which, in his view, would constitute a tied sale and justify compensation for moral damages.
Judge of São Luís Rejects Request for Compensation
In the compensation lawsuit, the consumer argued that the absence of the charger made the product incomplete and put him at a disadvantage.

He requested that Apple and the e-commerce responsible for mediating the purchase be ordered to refund the cost of the adapter and pay compensation for moral damages.
Judge Alessandro Bandeira, however, completely dismissed the requests. According to the ruling, selling the cellphone without the charger does not constitute a tied sale, as there was no imposition for the consumer to purchase the accessory directly from Apple.
The magistrate also noted that there was no legal basis to characterize moral damage due to the mere need to buy an adapter.
Consumer Alleged Tied Sale and Cellphone Unfit for Use
In the case documents, the plaintiff stated that he only noticed the absence of the charger after receiving the device. Without the proper adapter for the USB Type C port, he claimed that the iPhone could not be used normally.
For this reason, he stated that he was forced to buy an original Apple power adapter, the part that connects the power cable to the outlet.
Based on this situation, the consumer argued that the manufacturer had engaged in a tied sale by selling the iPhone without the charger and, at the same time, inducing the customer to buy the accessory separately. For the plaintiff, the additional purchase would constitute abusive imposition and a violation of the Consumer Protection Code.
Apple and E-commerce Defended Clear Information in the Offer
In its defense, Apple argued that there was no abusive practice because the consumer was properly informed at the time of the offer about the accessories that accompanied the device.
The company stated that when making the purchase, the customer was aware that the iPhone would be delivered only with the charging cable and without the wall adapter.
The e-commerce, in turn, claimed passive illegitimacy, emphasizing that it merely mediated the sale operation between the manufacturer and the consumer.
According to the platform, it was not its responsibility to answer for any flaws in the product kit composition, as it is not responsible for defining the items sent in the product box.
Decision Highlights Freedom to Choose Adapters
When analyzing the case, the magistrate emphasized that charging the cellphone can be done without the need for a specific Apple wall adapter, as long as the consumer uses compatible devices available in the market.
In the judge’s assessment, this preserves the customer’s freedom of choice, allowing them to decide to purchase an adapter from the manufacturer or opt for accessories from other brands.
In this context, the ruling reinforces that Apple is not required to sell iPhone with charger together with the device, as the consumer is not prevented from using the product.
For the judge, the ability to use adapters from different manufacturers, widely available in the consumer market, distances the notion of tied sale and prevents the recognition of abusive practice.
Consumer Awareness Weighed in the Conclusion of the Case
Another point emphasized in the ruling was the consumer’s prior knowledge of the purchase conditions.
The judge pointed out that the consumer’s own choice of the product and the completion of the transaction indicate that the plaintiff was aware that the iPhone would be delivered without the wall charger, accompanying only the cable for charging.
In the magistrate’s view, there was no coercion, imposition, or sufficient surprise to characterize a violation of consumer rights.
The ruling concluded that, based on the information provided at the time of the offer and the possibility of using the device with adapters available on the market, it was not possible to condemn Apple or the e-commerce to pay compensation or to refund the cost of the purchased accessory.
The case, registered under number 0802842-69.2025.8.10.0007, illustrates how the Judiciary has been analyzing discussions about the sale of cellphones without chargers, focusing on the transparency of information and the consumer’s freedom of choice regarding accessories.
In light of this decision, Apple is not required to sell iPhone with charger whenever it sells the device, as long as it makes the conditions of the offer clear and compatible adapters remain available in the market.
