Law No. 15,157/2025 Eliminates The Requirement For Periodic Examinations For People With Autism And Disabilities With Definitive Reports, Ensuring Stability And Security In Receiving BPC/LOAS.

Since the sanction of Law No. 15,157/2025, published in September 2025, the federal government has officially implemented a historic change to the Social Security Benefits Law (Law No. 8,213/1991): people with disabilities, including autistic individuals with definitive medical reports, will no longer need to undergo periodic examinations to maintain the Continuous Cash Benefit (BPC/LOAS).

The new rule represents relief for thousands of families who, for years, faced long queues and repetitive medical re-evaluations even in cases of permanent or irreversible disabilities.

Law 15,157/2025 Brings Legal Security And Reduces Bureaucracy In Accessing BPC

Before the new legislation, all BPC beneficiaries were required to be periodically called for new medical examinations — even those with stable or irreversible conditions, such as Autism Spectrum Disorder (ASD).

With Law 15,157/2025, this changes: the examination will be waived when there is a definitive medical report certifying that the disability is permanent and there is no expectation of improvement.

This measure aims to reduce bureaucracy, avoid unnecessary embarrassment, and ensure stability for beneficiaries. The text of the law also emphasizes that the medical report must contain ICD (International Classification of Diseases) and the signature of a qualified professional, ensuring the authenticity of the diagnosis.

Understand What Changes In Practice

The Continuous Cash Benefit (BPC/LOAS) is paid to people with disabilities and low-income elderly individuals and is equivalent to a monthly minimum wage (R$ 1,518.00 in 2025). With the new law, those who already have a definitive medical report will no longer need to appear periodically at INSS to renew the benefit — one of the main reasons for delays and undue suspensions of payments.

The rule applies to both physically, mentally, or intellectually disabled individuals, as well as autistic individuals, provided the diagnosis is confirmed as irreversible. In cases where the report is not considered definitive, the re-evaluation procedure remains valid.

A Milestone For Families With Autistic Individuals

The sanction of Law 15,157/2025 was celebrated by entities and associations linked to the autism cause. According to specialists in social security law, the measure brings predictability and legal security by ensuring that families of autistic individuals with permanent diagnosis are not required to undergo repeated examinations that would not change the granting of the benefit.

The new norm also officially recognizes the lifelong nature of ASD and other disability conditions that have no cure, reducing the emotional and financial strain on parents and guardians who depend on the benefit to ensure quality of life for their children.

Next Steps And Social Impact

With the publication of the law, the National Institute of Social Security (INSS) and the Ministry of Development and Social Assistance must update their systems to automatically waive re-evaluations in cases that fall under the new rules. The expectation is that thousands of families will benefit as early as 2026, when the regulatory ordinance is expected to be fully implemented.

The government estimates that around 1.2 million beneficiaries could be reached by the new norm, reducing administrative costs and wait times, and freeing health professionals for new cases and genuinely necessary reviews.
