Helmet Law in Effect Comes with Fines and Suspension of Driver’s License for Motorcyclists
Attention, motorcyclists! As usual, the helmet law not only imposes stricter rules for the use of the equipment but also brings severe penalties, such as fines and suspension of the driver’s license for motorcyclists who do not follow the guidelines. This measure aims to increase safety on the roads but is already causing concern among motorcycle, moped, and even motorized tricycle and quadricycle drivers. Many people may already know about this regulation, but it’s good to remind the requirements and the consequences.
When it comes to road safety, wearing a helmet is essential, just like a seatbelt in cars. The new helmet law is here to reinforce this message, but this time with a financial impact on motorcyclists and severe consequences for those who insist on not following the rule.
Helmet Law
According to Article 244 of the Brazilian Traffic Code, not wearing a helmet is considered a serious infraction. The fine is BRL 293.47, in addition to losing seven points on the National Driver’s License (CNH), and as if that weren’t enough, there are fines and suspension of the driver’s license for motorcyclists who violate the law. These amounts and penalties are in effect to ensure that the use of helmets is taken seriously, not only by riders but also by passengers.

Helmet Must Be Properly Fastened
The resolution of the National Traffic Council (Contran) of 2022, which establishes the guidelines for wearing a helmet, also imposes that the equipment must be properly fastened. If the helmet is not secured correctly, the infraction may be minor, but it still results in fines and points on the driver’s license. However, it is important to remember that these measures are not just to avoid penalties, but mainly to protect the lives of motorcyclists in case of accidents.
Does It Have Inmetro Seal?
In addition to fastening rules, the helmet law stipulates that only helmets with an Inmetro seal are permitted on public roads. The use of a visor is mandatory, and if the helmet does not have a visor, the motorcyclist must wear appropriate protective glasses. These regulations aim to ensure maximum safety under all driving conditions.
Statistics on Traffic Accidents Involving Motorcyclists
In Brazil, the statistics on traffic accidents involving motorcyclists are alarming, and the implementation of this new law seeks to reduce these tragic numbers. For many motorcyclists, the law may seem harsh, but the reality is that fines and suspension of the driver’s license for motorcyclists are necessary penalties to encourage the proper use of helmets and, thus, save lives.
Therefore, if you are a motorcyclist, pay attention to the rules. The proper use of the helmet is not just a matter of following the law, but of preserving your own life and avoiding headaches, both financial and legal. And remember: the helmet law is there to ensure that everyone can travel more safely, preventing serious accidents and their terrible consequences.
