The traffic law in Brazil may become even stricter with the possible approval of the Bill (PL) 1405/24, which is under discussion in the Chamber of Deputies. The proposal, presented by Congressman Clodoaldo Magalhães (PV-PE), provides for higher fines and harsher penalties for drivers who engage in dangerous overtaking or drive irresponsibly, putting the lives of others at risk.
Higher Fines and Stricter Penalties for Serious Violations
If approved, the new traffic law will make any overtaking considered dangerous a serious violation.
The bill defines this maneuver as any overtaking that is in violation of traffic regulations and poses an imminent risk to road safety, physical integrity, or life of individuals.

A fine of R$ 2,934.70, equivalent to ten times the base value of a serious violation;
Addition of seven points to the offender’s driver’s license;
Suspension of the right to drive for 12 months;
In case of re-offending within a year, the suspension of the driver’s license will be doubled, reaching two years without the ability to drive;
Prohibition from driving on highways and roads for two years, starting from the date of the offense.
With these measures, the aim of the bill is to reduce the number of traffic accidents caused by reckless driving, making roads and highways safer for all users.
The Path of the Bill Before Approval
Although the proposal is already being debated in the Chamber of Deputies, there is still no forecast for its entry into effect.
The PL 1405/24 must go through a lengthy legislative process before becoming law.
Currently, the text is under review by the committees of Transportation and Transit, Constitution and Justice, and Citizenship.
After this stage, the proposal will need to be approved by both the Chamber of Deputies and the Federal Senate.
Only after that will it go for presidential sanction.
