MPF Requires Chevrolet to Pay Millions for Structural Flaws in the Onix. Lawsuit Seeks Compensation for 4,189 Customers and May Result in a Recall of Brazil’s Best-Selling Model

The Federal Public Ministry (MPF) filed a public civil action against General Motors do Brasil (GMB), demanding that the automaker pay R$ 92 million in compensation to 4,189 customers of the Chevrolet Onix model. According to the agency, vehicles produced between 2012 and January 14, 2018, have structural flaws that compromise safety in side impacts.

According to the MPF, the problem was identified in several tests and technical reports, leading to the request for reparations to affected consumers. The process includes a request for Chevrolet to conduct a recall of the model to correct the defect, ensuring compliance with safety standards required by the Brazilian market.

Accidents and Flaws in the Chevrolet Onix

Data attached to the process reveal that, between 2018 and 2024, 4,189 accidents involving the Chevrolet Onix were recorded. Of this total, 1,546 resulted in minor injuries, 290 in serious injuries, and 48 in deaths. According to the MPF, the car’s structural flaws contributed to the severity of side impacts.

The lawsuit is based on studies indicating that vehicles manufactured during this period do not meet minimum requirements for strength and safety, putting drivers and passengers at risk. The accusation argues that Chevrolet sold a car with structural deficiencies, without properly informing consumers about the risks.

How Will Compensation Be Made?

The MPF proposed that Chevrolet pay financial compensation according to the damages suffered by the victims:

  • R$ 100,000 for the families of each fatal victim;
  • R$ 50,000 for customers who suffered injuries in accidents due to the problem;
  • An additional amount for collective moral damages, the amount of which will be defined based on Onix sales during the period.

If affected consumers cannot prove damages individually, the amount will be allocated to the Fund for Diffuse Rights, which finances consumer defense and vehicle safety projects.

MPF Reinforces Recall Request and Chevrolet Responds

In addition to the compensation, the MPF requested that the court order an immediate recall of the Chevrolet Onix, forcing the automaker to correct the structural problems at no charge. The agency also requested a summary judgment in the case, without the need for further evidence or hearings.

In response, General Motors stated that “the Chevrolet Onix fully meets the technical specifications required by Brazilian legislation” and that it does not comment on ongoing legal proceedings.

The case will be analyzed by the 3rd Federal Civil Court of the Federal District, which will decide whether Chevrolet must pay the compensations and carry out the recall of the model.
