Congress Approves New Rules Including Drug Testing for All Categories and Benefits for Low-Income Drivers
The National Congress recently approved a project that brings significant changes for drivers, including the mandatory drug test for obtaining the National Driver’s License (CDL), according to the G1/Globo website.
This change, which still needs to be sanctioned by President Luiz Inácio Lula da Silva, may undergo modifications if certain sections are vetoed.
With this new legislation, Brazil aims to increase safety on the roads and ensure that all drivers are fit to drive safely.

The Importance of Drug Testing
The inclusion of the drug test in obtaining the CDL is a measure aimed at detecting the use of psychoactive substances that may compromise driving ability.
This test is essential as it can identify the consumption of drugs that are not easily detectable in quick tests, such as the use of marijuana, cocaine, and amphetamines.
Did you know that the test can detect substance use up to 90 days after consumption? This is crucial for preventing accidents and ensuring everyone’s safety on the roads.
Who Needs to Take the Drug Test?

With the new rules, all drivers seeking their first license, regardless of category, will need to undergo the drug test. This includes the following categories:
- A: two or three-wheeled vehicles, such as motorcycles, mopeds, and tricycles.
- B: vehicles with up to eight passengers, such as cars, vans, and pickups.
- C: trucks and cargo vehicles.
- D: buses, minibuses, and passenger transport vehicles with more than 8 seats.
- E: combinations of vehicles (e.g., tractor unit + attached unit).
This requirement was already in place for drivers of categories C, D, and E, but now extends to all drivers, increasing safety on Brazilian roads.
How do you feel about this change? Do you think it will really help reduce accidents?
What Changes for Professional Drivers?
For drivers who already hold a CDL in categories C, D, and E, there are no changes, as the drug test was already mandatory for both obtaining and renewing the license.
However, this expansion of the rules highlights the need for awareness about the impact of psychoactive substance use on driving.
The question remains: are all drivers aware of the risks associated with drug use and vehicle operation?
Drugs Detected in the Test
The drug test uses samples of hair, saliva, or nails to identify the consumption of psychoactive substances. Among the drugs that can be detected are:
- Amphetamines
- Cannabinoids (such as marijuana)
- Opioids
- Cocaine
- Mazindol, a weight loss medication.
This test has a validity of 90 days from the date of the sample collection, meaning it can detect drug use over an extended period.
This raises the question: do you believe this detection window is sufficient to ensure that drivers are not under the influence of drugs while driving?
Where to Take the Drug Test
Currently, the drug test must be conducted at laboratories accredited by the National Traffic Department.
For more information about locations and procedures, you can consult the website of the Ministry of Transport.
This centralization of information is an important step to facilitate drivers’ access to the test.
Introduction of the Social CDL
Another significant change brought by the project is the creation of the Social CDL, which aims to help low-income individuals obtain their driver’s license.
Funds collected from traffic fines will be used to cover the costs of the CDL for these individuals.
To be eligible for the Social CDL, the applicant must be registered in the Unified Registry for Social Programs of the Federal Government (CadÚnico).
This initiative can open doors for many people who would otherwise lack the financial means to obtain a license.
Do you think this measure can truly help increase social inclusion?
Online Vehicle Transfer
In addition to changes related to the drug test and the Social CDL, the project also allows for the complete transfer of vehicles on an electronic platform.
This includes the requirement for a validated purchase and sale contract with digital signatures, which must be done through approved platforms.
The inspection for the transfer of ownership can be conducted electronically, according to the decision of the traffic executive agency in the states and the Federal District.
This innovation brings greater convenience and speed to drivers and vehicle buyers.
When Do the New CDL Rules Take Effect?
For all these new rules to take effect, they must be sanctioned by the President of the Republic.
What do you expect to happen with these changes? Do you believe they will bring real benefits for traffic safety? Leave your thoughts and comments below!
