New Category Will Be Entitled to a Hazard Pay of 30%. Traffic Agents Will Start Receiving the Benefit After Regulation by the Ministry of Labor, but Payment Will Depend on Technical Report.
The federal government confirmed this Friday (22) that a new category will be entitled to a hazard pay of 30%. The measure was formalized by the Minister of Labor and Employment, Luiz Marinho, who signed the order regulating the payment for traffic agents. This decision alters the Regulatory Standard No. 16 (NR-16) and gives effect to the Law No. 14.684/2023, approved by Congress last year.
The achievement recognizes the high risks of traffic enforcement activities, such as collisions, runovers, and even episodes of urban violence. However, the benefit will not be paid automatically. A technical report prepared by an occupational doctor or safety engineer will be required, proving exposure to risk, as determined by the CLT.
Why Will Traffic Agents Be Entitled to the Additional Pay?
Working on public roads is considered high risk since agents deal daily with heavy vehicle traffic, accidents, and conflicts with drivers. The regulation places the category in the same group of professionals as electricians, security guards, and workers handling flammable or explosive materials, who already receive the 30% hazard pay.

In other words, the benefit is guaranteed by law, but its implementation will require proof and additional regulations in many cases.

For traffic agents, the change means a real increase in remuneration, as the hazard pay is 30% of the base salary. Additionally, the measure strengthens the recognition of the activity as essential for road and urban safety.
However, labor law experts warn that the requirement for a technical report may lead to legal disputes and delays in payment implementation, especially in cities where local governments do not regulate the measure immediately.
The decision to include traffic agents among workers with the right to a hazard pay of 30% is considered a historic victory for the category, but implementation will vary among municipalities and states.
