Government Evaluates Changes in the Licensing Process, with Classes to Be Conducted by Accredited Autonomous Instructors, Public Consultation Open and Expectation of Cost Reduction for Candidates Seeking the National Driver’s License.

President Luiz Inácio Lula da Silva has approved the Ministry of Transport to move forward with a proposal to eliminate the mandatory attendance at driving schools in the process of obtaining the National Driver’s License.

The measure, according to the ministry, will be subject to a 30-day public consultation, starting this Thursday (2), according to information from the newspaper Folha de S. Paulo.

According to the cited publication, the government claims that the initiative aims to reduce costs and expand access to the CNH, without changing the requirement for the theoretical and practical tests, which remain mandatory steps.

What Changes in Driver Training

Under the proposed framework, theoretical and practical classes will no longer be a mandatory requirement at driver training centers and may now be conducted by accredited autonomous instructors.

These professionals will need to pass an evaluation administered by the federal government and be registered with the Detrans and the National Traffic Secretariat.

In general terms, the candidate’s preparation will be flexible: each person can choose how to study and whom to train with, as long as they meet the examination requirements set forth in the Brazilian Traffic Code.

According to information from the Folha de S. Paulo, the model stipulates that autonomous instructors must meet rigorous qualification and safety criteria, under direct supervision from Senatran, to prevent fraud and ensure quality in training.

How the Process Will Look Until the License

The proposal maintains the theoretical examination (legislation, defensive driving, and first aid) and the practical driving test.

The training prior to these tests will no longer be standardized by minimum hours and will become optional, conducted by independent instructors or, if the candidate prefers, by driving schools.

In a recent communication, the Ministry of Transport informed that the initiation of the licensing process will occur through the Senatran portal or the Digital Driver’s License, with step-by-step instructions for registration and scheduling.

Why the Government Advocates for the Change

For Minister of Transport Renan Filho, the current requirement increases costs and excludes potential drivers, encouraging driving without a license.

“The mandatory driving school has created an exclusionary system, and people drive without a license, which is the worst of worlds,” he stated recently.

In another comparison he made, mandatory driving school would be akin to requiring that a candidate for public university have, necessarily, attended preparatory courses: “Driving school is that.”

According to the ministry, the expectation is to significantly reduce the process cost, with internal estimates of reductions of up to 80% for categories A and B.

The calculation takes into account the elimination of minimum hours and the possibility of direct hiring of accredited instructors, without mandatory intermediation from training centers.

Public Consultation: What Will Be Discussed

The public consultation that begins this Thursday (2) will last for 30 days to receive contributions from citizens, experts, sector entities, state, and municipal governments.

The goal is to gather suggestions on credentialing criteria for autonomous instructors, safety requirements for practical classes on the roads, content standards for theoretical training, and supervisory procedures.

The results will serve as a basis for the draft resolution from Contran, which will regulate the new model.

During this period, the Ministry of Transport will also hold a public hearing to delve into technical points, such as instructor evaluation parameters, civil and criminal responsibilities during classes, and the interaction of state Detran systems with Senatran for registration and auditing.

The Role of Contran and Next Steps

As the requirement for courses is included in infralegal norms from the National Traffic Council (Contran), the change must be consolidated in a new resolution.

In practice, after the public consultation and hearings, the proposal will return to Contran for deliberation and publication.

From there, Detrans will need to adjust systems, workflows, and credentialing requirements, in addition to modifying exam and inspection procedures.

The newspaper Folha de S. Paulo also noted that the final regulation will need to detail requirements for instructional vehicles, safety requirements, insurance rules, and mechanisms for auditing classes to prevent irregular practices.

How the Change May Affect Candidates and the Market

If the new rule is confirmed, the candidate will have more autonomy to organize their preparation, including combining individual study, digital content, standalone in-person theoretical classes, and practical training with independent instructors.

For those who choose to continue with driving schools, nothing prevents the hiring of traditional packages; the difference is that they will no longer be a prerequisite for scheduling the exams.

In the market, the expectation is for a reorganization of the training sector.

Driving schools will still be able to offer services but will compete with accredited autonomous professionals who will operate under credentialing and supervision.

The government argues that competition is likely to reduce prices and expand the reach of the service, especially in regions with a low supply of training centers.

Safety and Inspection Remain Central

Authorities emphasize that road safety will remain a central focus of the process.

The candidate will still be required to pass the official tests, which assess knowledge of rules and the ability to drive in real traffic conditions.

The flexibility pertains to the means of preparation, not to the final evaluation.

Inspection of instructors and classes will need to be strengthened through credentialing, traceability of services, and sanctions in cases of irregularities.

How to Participate Practically

Those interested in submitting contributions may do so via the electronic channel of Senatran indicated at the start of the public consultation.

The recommendation is to present objective, justified, and focused suggestions on regulatory items, such as credentialing criteria, vehicle requirements, instructor experience verification model, minimum content parameters, and anti-fraud control mechanisms.

After the 30-day period, the Ministry will compile the proposals and publish a social participation report, which will serve as the basis for the final drafting of the resolution.
