Have You Ever Imagined Being Punished With An Astronomical Fine And The Suspension Of Your License For Overtaking? It Seems Like A Drastic Scenario, But It Is Exactly What Could Become Reality If The Latest Bill Is Approved.
This proposal, which promises to reformulate punishments for dangerous overtaking, is causing a true revolution in discussions about road safety and may directly affect the way you drive. Continue reading to understand all the details of this proposal and how it may impact your life.
The bill under consideration defines “dangerous overtaking or reckless driving” as any maneuver that does not comply with traffic rules and poses an imminent risk to road safety, life, or physical integrity of individuals.
The proposal aims to toughen punishments for those who engage in overtaking under adverse conditions or in a reckless manner, increasing fines and penalties associated with these violations.

Fine And Penalties
According to the proposal, the fine for the offense of dangerous overtaking will be R$ 2,934.70, an amount equivalent to ten times the base value of a severe fine.
Additionally, the offense will result in 12 months of suspension of the right to drive and seven points on the driver’s license. In case of reoffending within a year, the suspension will double, totaling 24 months without the ability to drive.
Another significant measure of the bill is that drivers punished for dangerous overtaking will be prohibited from driving on highways or roads for a minimum period of two years from the date of the offense.
This proposal reflects the growing concern for safety on the roads and the need for more severe penalties to deter behaviors that put lives at risk.
Recent Data On Fines
In 2023, Brazil recorded approximately 2 million violations related to dangerous overtaking, according to data from the National Department of Traffic (DENATRAN). In 2024, by July, this number had already reached around 1.1 million.
Impact Of The New Rules
The implementation of the proposed new rules may have a significant impact on how drivers approach driving and overtaking.
Studies indicate that higher fines and longer suspensions have a direct effect on reducing risky behaviors.
For example, data from the World Health Organization (WHO) shows that countries with stricter traffic policies tend to have lower rates of accidents and traffic fatalities.
Additionally, the proposal may influence how traffic authorities conduct enforcement. With fines and penalties being more severe, an increase in surveillance and enforcement of traffic laws is expected, contributing to a safer environment for all road users.
Next Steps
Currently, the bill is undergoing a conclusive analysis process by the committees on Transportation and Traffic, and Constitution, Justice and Citizenship. To become effective law, the proposal still needs to be approved by the House of Representatives and the Senate.
The progress of the proposal will be closely monitored by road safety experts and society, who are expecting a more effective response to the traffic issues faced daily.
