Project Under Review in the Chamber Proposes Online Course of 20 Hours, with Periodic Updates for Motorcycle Taxis and Motorcycle Freight. The Measure Conditions Regular Work to Valid Certification and Provides for Administrative Consequences in Case of Noncompliance.

A project submitted in the Chamber of Deputies proposes to create a new obligation for those intending to work with a motorcycle, in the motorcycle taxi and motorcycle freight modalities.

The PL 379/2025, authored by Congressman Yury do Paredão (MDB-CE), amends the Law 12.009/2009 to make a periodic professional update course mandatory, with a minimum load of 20 hours, offered in online mode, to be taken every two years.

The measure, if approved, directly affects those obtaining or planning to obtain a Category A driver’s license for professional purposes, as it conditions the regular exercise of the activity to the presentation of an updated completion certificate.

Ongoing Condition to Operate in Motorcycle Taxi and Motorcycle Freight

The text of the project stipulates that periodic training be a continuous requirement for the operation of motorcycle taxi drivers and motorcycle couriers.

In the proposed wording, at each two-year cycle counted from the start of service provision, the professional will need to retake the course and prove the update.

The certificate will function as a document of qualification, to be included in the records consulted by traffic authorities and municipal agencies that issue permits.

In case of non-compliance within the deadline, the exercise of the activity is prohibited until regularization; if the pending issue persists for more than 30 days after notification, the license permit may be suspended or canceled according to local regulations.

Content and Objective of the Training

The proposal specifies that the update course will be offered online, aiming to broaden access and standardize content.

The minimum load of 20 hours is described as the basic parameter, to be detailed in subsequent guidelines.

The focus is on updates in road safety, defensive driving, riding techniques in urban environments, vehicle preventive maintenance, protective equipment, and good practices in passenger service or cargo transport.

The justification presented by the author cites the expansion of app-based work and the increased pressure for delivery speed as factors that require periodic retraining, in order to keep up with operational and regulatory changes.

Processing in the Chamber of Deputies

The processing points to the Commission on Roads and Transport as the first step in the Chamber, in a conclusive appreciation in committees.

In practice, if it receives a favorable opinion and there is no appeal to the Plenary, the text may proceed to the Senate without a vote in the larger body.

As of the last update consulted for this report, the project was awaiting the assignment of a rapporteur in the CVT, without a voted opinion.

In subsequent phases, the examination by the Commission on Constitution and Justice and Citizenship is expected, responsible for assessing constitutionality, legality, and legislative techniques.

Any substantive changes in the committees may adjust deadlines, content, certification criteria, and registration obligations.

The Law 12.009/2009, which currently regulates motorcycle taxi and motorcycle freight activities, already requires prerequisites such as a minimum age of 21 years, at least two years of licensing in category A, and approval in a specialized course regulated by Contran.

The PL 379/2025 acts on this normative basis by introducing the need for periodic updates and by specifying that the maintenance of the permit is conditional on retraining within the established timeframe.

As a result, the proposal shifts part of the compliance control to the regular monitoring of certificates by traffic executive agencies and municipal licensing authorities.

Impact for Those Planning to Obtain a Category A Driver’s License for Work

For those starting the licensing process with the intention of working with a motorcycle, the change creates a recurring commitment to training from the moment they enter the activity.

Although the update course is not part of the steps for obtaining the first driver’s license, it impacts the planning of those preparing to complete the full professional pathway.

In practical terms, the candidate who completes the initial training and obtains the license for motorcycle taxi or motorcycle freight will incorporate, every two years, a mandatory retraining hour load, with formal registration.

The online format reduces the need for commuting and tends to facilitate the organization of schedules, but the requirement adds cost and time to the documentation maintenance cycle.

Monitoring, Registrations, and Administrative Effects

The text of the project ties the obligation to administrative proof and provides for consequences for the lack of updates.

The temporary prohibition of practice aims to induce regularization, while the possibility of suspension or cancellation of the permit after noncompliance for 30 days acts as a more severe sanction.

According to the proposal, the application of these effects depends on parameters defined by the competent authorities, observing municipal regulation and integration with licensing databases.

In environments where there is electronic monitoring of permits and integration of databases with Detrans, the tendency is for the verification of the updated course to occur in real time.

Technical Regulation and the Role of the National Traffic System

The adoption of a standardized online course relates to the role of the National Traffic System in defining content and assessment.

Although the PL establishes the minimum duration and modality, it will be up to subsequent regulations to detail pathways, learning verification instruments, and rules for issuing certificates.

It is at this point that Senatran and Contran usually define modules, tutoring criteria, and technological requirements for platforms, as well as audit procedures and provider accreditation.

The arrangement is similar to that of existing specialized courses, adjusted to the recurrence of updates provided for in the project.

Safety, Work Organization, and Standardization

The proposal engages with ongoing discussions in Congress about the safety of motorcyclists and work organization on two wheels.

In hearings and technical notes, public managers and entities often associate frequent retraining with gains in defensive conduct and in service regularity, especially in capitals and metropolitan regions with high delivery density.

The choice of online format follows the guidance of reducing logistical barriers and facilitating the adherence of professionals who work long hours, without dismissing the need for effective control of attendance and performance, to be designed in the regulation.

Costs, Deadlines, and Gaps to Define

From the perspective of the service user and traffic in general, proponents of the project relate periodic updates with a reduction in traffic violations during peak hours, better risk management in sharing lanes, and greater compliance with local rules on circulation and stops.

For the professional, the predictability of deadlines and standardized content tends to facilitate the renewal of certification and avoid discrepancies in requirements between municipalities.

For the monitoring agencies, the integrated verification of the certificate with other requirements of Law 12.009/2009 can simplify approaches and sanctions, as long as the databases are interoperable.

In the economic context, the measure introduces a periodic cost that must be considered by those intending to enter the segment.

The definition of values, however, is not in the project and will depend on the regulated market and subsequent normative acts.

The course duration, defined at 20 hours, creates a minimum dedication ceiling and can be distributed according to the platform defined in regulation.

In scenarios of high demand for deliveries, the option for distance learning offers flexibility, which, in theory, reduces operational impacts, without excluding the need for formal proof of completion and pedagogical quality.

Faça uma lei para equiparar as 2 profissões como os taxistas com linha de crédito mais barato para aquisição de motocicleta , quando a lei 12009/2009 foi criada a intenção era essa porém os profissionais investiram na profissão e o poder publico não fizeram sua parte.ou fizeram somente na cobrança, onde o profissional pra colocar sua motocicleta de acordo com a lei com pagamento de dudas e cursos especializado gasta-se quase 800,00 a depender de cada estado, há mais os cursos especializado é oferecido pelo Detran de forma gratuito, isso é até verdade difícil é ter com frequência para atender a demanda,no RJ quando abre turma é quase 3 meses ou mais.

Esse projeto é somente para criar mais uma borocracia,e outra coisa a prática para essas duas categorias são muito mais importantes do que simplesmente parte teórica…

Vejo esse projeto como desnecessário, talvez seja mais arrecadatorio, embora não se tenha mencionado valores. A lei 12009/2009 que regulamenta a categoria de motofrete e mototaxi já trata dessa questão.onde tem curso especializado com validade de 5 anos, após esse prazo atualização . fazer lei pra mudar o que já existe, tem que fazer uma lei que obrigue os aplicativos que fazem a prestação desses serviços a cumprirem a lei 12009/2009. Se a lei diz que pra exercer a função de motofrete ou mototaxi o condutor precisa ser maior de 21 anos estar habilitado no mínimo 2 anos de categoria A, ter placa vermelha categoria aluguel, curso especializado.exercer atividade remunerada, então esse projeto não faz sentido nenhum. Faça um projeto onde todos os profissionais estarão cumprindo a lei 12009/2009 no mínimo resolveria muitos problemas, inclusive acidentes.
