The sanctions are provided for in the Draft Bill (PL) 222/2025, which amends Municipal Law No. 4,219/2012 and is under review in the Municipal Chamber.

According to the project, non-compliance with the rules subjects the offender to warnings with notifications and a maximum and non-extendable period of 30 days for regularization.
If the problem persists after this period, a fine of R$ 500 per infraction applies, with double the amount for each recurrence, up to the ceiling of R$ 8 thousand.
The grading seeks to stimulate rapid correction and deter the maintenance of out-of-use or unregulated gauges.
How to Report and Defend Yourself
Reports can be filed by any citizen, and the fined establishment will have 10 days to respond to the competent authority after receiving the notification.
If the defense is declined, the text establishes that the fine must be paid within 15 days.
The provision of a process with defined deadlines aims to expedite the administrative process while safeguarding the merchant’s right to defense.
Destination of Funds and Start of Validity
The amount collected from fines will be allocated to programs and social actions aimed at people with disabilities, unless the public authority determines another priority of public interest.
Once approved and published in the Official Gazette of the Municipality, the project provides for a vacatio legis of 45 days for the rule to take effect.
During this period, gas stations must adjust equipment and procedures.

The justification for the bill mentions that many gas stations maintain broken gauges or out of standards set by metrology agencies, such as Inmetro and Imepi.
The document also notes the risks of tires with inadequate pressure, which can increase fuel consumption, cause irregular wear, and compromise roadway safety.
In a statement, the author claims that the issue has been treated with less priority than public interest demands.
“Although calibration is a free service, its importance is undeniable and cannot be treated as a secondary matter by gas station owners,” said councilman Carlos Ribeiro.

The PL 222/2025 was filed on September 18, 2025 and has already undergone reading in the plenary, awaiting a report from the Legal Advisory before proceeding to the thematic committees and then to the plenary vote.
If approved by the councilors, the text will be sent for sanction by the mayor Silvio Mendes (União Brasil), who began his third term at the head of the Teresina City Hall on January 1, 2025.
Until the conclusion of the legislative process, the obligations set by Law 4,219/2012 remain valid without the additional penalties now proposed.
