Proposal Advancing in Congress Could Change the Process of Renewing the CNH Across the Country, Requiring Psychological Testing for All Drivers and Prohibiting Driving for Those Who Fail If It Is Sanctioned.

The requirement for psychological evaluation at all stages of CNH renewal has advanced in Congress and could affect all drivers, not just professionals.

The PL 4111/2023, originating from the Senate, is in conclusive proceedings in the Chamber of Deputies, following approval in the Commission on Transportation and Traffic (CVT) in August 2024; the text is awaiting deliberation by the Commission on Constitution and Justice and Citizenship (CCJC).

If it becomes law, those who fail the exam will not have their license renewed and, without a valid CNH, will be prohibited from driving until a new assessment and approval.

What Changes for the Driver

Today, psychological evaluation is mandatory for the first license and, for renewals, only for those who engage in paid activity at the wheel.

The proposed change extends the requirement to all drivers at the time of renewal, along with the physical and mental fitness exam.

This stage would be included in the process of the Detrans, with scheduling, execution, and recording of the result in the driver’s record.

The detailed regulation, such as technical parameters and periodicity aligned with ages and the validity of the CNH, will be the responsibility of Contran if the project is approved.

Currently, Resolution 789/2020 from Contran provides for psychological evaluation in obtaining the CNH, in renewal only for those who engage in paid activities, in the replacement of foreign documents, and at the request of the expert.

Current Status of the Project

The text originated from PLS 98/2015, authored by Senator Davi Alcolumbre, and was approved in final decision by the CCJ of the Senate on August 9, 2023.

Subsequently, the proposal followed to the Chamber.

On August 14, 2024, the CVT approved a favorable report and sent the matter to the CCJC.

On December 11, 2024, the rapporteur in the CCJC, Deputy Hugo Leal, presented a report on constitutionality and good legislative technique.

On April 9, 2025, the committee removed the project from the agenda at the request of the rapporteur, and the most recent recorded situation remains as “ready for the agenda” in the CCJC.

Due to being processed conclusively, the proposal may be approved in the committees and proceed to sanction, unless appealed for voting in the Plenary.

Failure in the Psychological Exam

If the psychological evaluation becomes a requirement for renewal and the driver fails, the CNH will not be renewed.

In the absence of a valid document, driving with an expired license for more than 30 days is a serious violation, subject to fines and vehicle retention until a licensed driver is presented.

In practice, until there is approval in a new evaluation and the consequent renewal, the driver is prohibited from driving.

This rule stems from Article 162, item V, of the Brazilian Traffic Code (CTB), already in effect.

Operational and Financial Impacts

The adoption of the exam for all renewals would create an additional mandatory step, impacting time and cost for the driver, as well as the need for appointments at accredited clinics.

Currently, procedures and accreditations are regulated by Contran standards and executed by state Detrans; any expansion of the audience would require adjustments in the availability of schedules and service capacity.

The definition of values is not in the project and depends on state policies and the accredited network.

The operational details — deadlines, flows, and systems — will only be established in subsequent regulation, if the proposal is approved.

Arguments and Justifications

The rationale of the project argues that the emotional condition of the driver varies over time and that periodic reevaluations can reduce risks on the roads.

In the Senate, the rapporteur was Senator Fabiano Contarato, who provided a favorable opinion and approval in the CCJ.

In the Chamber, the CVT also approved the text, highlighting the role of psychological evaluation in the set of road safety measures.

The CCJC, in turn, limited itself to an analysis of constitutionality, legality, and legislative technique.

Position of Entities and Specialists

Transit and Psychology entities are following the topic.

The Federal Council of Psychology (CFP) advocates for expanding the evaluation to all renewals, arguing that subjective factors evolve and may influence behavior behind the wheel.

Official communications and informational materials from the council indicate support for the measure and document the progress of the project since 2023.

Next Steps in Congress

Without a final vote in the CCJC up to the last official record, the project remains pending on the agenda.

If the committee approves without changes to the merit, the proposal may go directly to presidential sanction. If there are changes, it returns to the Senate for revision.

In any scenario, implementation will require Contran to issue acts to detail procedures, deadlines, and technical criteria, in order to integrate psychological evaluation into the license renewal cycle across the country.
