Created From The Overindebtedness Law, The New Government Program Allows Elderly People Over Sixty To Renegotiate Debts In A Single Hearing, Reorganize Installments That Exceed Income, And Preserve Rent, Utilities, Food, And Basic Medicine, Avoiding Immediate Cut-Off Of Essential Services And Protecting The Budget

Since 2021, when the new overindebtedness law came into effect nationwide, the new government program aimed at elderly consumers has started to gain traction as an official tool to address debts that exceed monthly income. The model is based on the idea that no one should be forced to choose between paying the bank or maintaining basic necessities such as rent, utilities, food, and essential medications.

In 2025, with the rise of debt among people over sixty and the burden of credit cards, loans, and installment payments on pensions and retirement benefits, the new government program has consolidated as a structured path to renegotiate everything in a single hearing, bringing together multiple banks at the same time and building a payment plan that respects the so-called existential minimum for the elderly.

What Is The New Government Program For Overindebted Elderly People

In practice, the new government program is the organized application of the overindebtedness law in favor of consumers who can no longer pay all their debts without sacrificing basic expenses.

It is primarily aimed at retirees, pensioners, and workers over sixty who have compromised their income with expensive credit and successive contracts.

The law considers a good faith consumer who can no longer afford to simultaneously cover:

installments of loans, credit cards, and financing

overdue bills that have become formal collections

essential expenses for housing, food, utilities, and medications

The focus of the new government program is to rebuild this equation through a comprehensive payment plan, where the elderly present their entire financial situation, creditors are called to negotiate, and the judge or consumer protection agency helps to create a single proposal, with deadlines and amounts compatible with actual income.

How Does Renegotiation Work In A Single Hearing

One of the pillars of the overindebtedness law is the so-called global conciliation hearing.

Instead of negotiating separately with each bank, card, or financial institution, the new government program allows the elderly to gather all creditors in a single procedure, reducing pressure, persistent calls, and isolated proposals that are difficult to compare.

In the hearing, the following are presented:

proven income of the elderly

complete list of debts and creditors

minimum expenses for rent, utilities, food, and medications

monthly payment capacity remaining after essential expenses

Based on this data, a collective payment plan is developed, with interest reductions, extended terms, and readjusted installments to an amount that fits the budget.

In many cases, the judge can approve this plan, giving legal force to the agreement and obliging the present creditors to follow the approved conditions.

What Is Protected: Rent, Utilities, Food, And Medicine

A central point of the law and the new government program is the protection of the existential minimum.

This means that, when creating the payment plan, the elderly cannot have fully compromised amounts intended for:

rent or housing installments

utility bills necessary for the functioning of the home

basic family nutrition

continuing medications and essential health treatments

Renegotiation cannot transform the elderly’s life into a sequence of cuts and deprivations merely to satisfy financial creditors.

Instead, the program seeks a balance: to preserve essentials and adjust what is possible in debts, within a limit that does not push the consumer into an even more precarious situation.

Who Can Seek Help And Where To Start

To access the new government program, the path usually goes through public consumer protection agencies or the judiciary:

State and municipal consumer protection agencies

Public defenders

Special civil courts and specialized consumer relations courts

In general, the elderly need to bring documents such as:

ID, CPF, and proof of residence

proof of income (INSS benefit, paycheck, bank statement)

contracts, credit card bills, coupons, and collection letters

rent, utility, water, and pharmacy bills, showing the weight of basic expenses

With this material, the new government program assesses whether there is overindebtedness and, if confirmed, forwards to a hearing with creditors.

The elderly can count on free legal support when they cannot afford to pay for a private lawyer.

Care Before Signing Any Renegotiation Agreement

Even within the new government program, the recommendation is that the elderly do not sign proposals without clearly understanding:

the final amount that will be paid over the plan

the number of installments and the monthly impact on the budget

whether there will be any need to give up any rights or additional guarantees

whether other essential expenses will still fit into the income after the agreement

The goal of the overindebtedness law is not to swap an unpayable debt for another, just a longer one, but to establish a healthy limit for income commitment.

Whenever an offer seems excessive, it is important to ask for clarifications in the hearing itself or request a review from the responsible agency.

What The Elderly Should Avoid To Not Worsen The Situation

While participating in the new government program, the elderly need to be extra cautious not to incur new debts that fall outside the negotiated plan. Among the most common risks are:

taking out another loan to pay off old installments

falling for aggressive offers of payroll loans promising to “clean the name quickly”

using credit cards as an extension of monthly income

signing documents without thorough reading or without help from a trusted person

The overindebtedness law also targets abusive practices by financial institutions, such as tied sales, concealment of real interest rates, and offering credit that is clearly incompatible with the elderly’s income.

When these abuses are identified, part of the debts may be reviewed or even annulled, reinforcing the need to undergo the program’s analysis before accepting any isolated proposal.

Mundo insano! O governo gere o INSS que faz empréstimos aos aposentados, com juros abusivos e muitas vezes sem consentimento. Aí o próprio governo cria um serviço para renegociar as dívidas!

Esse governo quer pegar carona em tudo que a eleição é benéfico. Não há nada de governo nisso tudo. Trata-se apenas e tão somente da lei do super endividamento, que visa proteger o idoso de boa fé, como parte de uma parcela economicamente vulnerável da sociedade, contra orgaos do próprio governo, como os bancos públicos, que costumam explorar os pobres para lucrar bilhões.
