The Superior Court of Justice (STJ) has scheduled for September 10, 2025 the judgment of Theme 1124, which will determine when the financial effects of social security actions start to apply. The decision will directly impact thousands of INSS insured individuals who are awaiting in court for pending amounts that may reach billions of reais.
According to attorney Elizelton Reis Almeida, a specialist in Social Security Law, this judgment is one of the most anticipated of the decade, as it will standardize the understanding of a topic that creates legal uncertainty and affects retirees across Brazil. The definition will be crucial for workers who have already filed administrative requests but had to turn to the courts to prove their rights.
What Is at Stake in Theme 1124
The central point of the judgment is to define when the insured individual has the right to receive the pending payments. Two interpretations are in dispute:

This halted actions regarding special retirement, retirement by contribution time, and benefit revisions in courts across the country. Thousands of insured individuals have been waiting for a definition without progress in their cases and without access to the amounts owed.
The judgment was even initiated but was interrupted after a minister’s request for further review. The rapporteur had already voted to limit the financial effects to the date of judicial notification, but the plenary has not yet confirmed this position. Now, with the new date set, the expectation is that the deadlock will be resolved.
Financial and Social Impact of the Decision
The STJ’s decision will have national effects and will serve as a mandatory guideline for all Brazilian courts. This means that thousands of unlocked retirement and revision processes will automatically follow the established guidance.
If the interpretation more favorable to the insured prevails, the Union and INSS may have to bear billion in retroactive payments, escalating the volume of precatories and RPVs (small value requests). Conversely, if the more restrictive understanding prevails, retirees will receive less, but the government will experience a smaller fiscal impact.

Se não RVT tinha sido ganho, foi para o STF e lá fizeram roubo aos aposentados, deve seguir nessa mesma linha esse processo, justiça? Só para os ****.
Com certeza limitar a citação é um verdadeiro retrocesso, uma vez, o que se define o direito é o cumprimento dos requisitos pra sua obtenção. Aliás, limitando-o, seria beneficiar a própria torpeza do órgão previdenciário, que diante do direito adquirido à percepção do beneficio, nega sua concessão, obrigando os beneficiários a recorrerem ao judiciário. Injustificável, também é a paralisação por 04 anos, aguardando manifestação do judiciário, no qual tenho respeito, mas a salvaguarda dos interesses das classes de beneficiários, dado o grau de vulnerabilidade, mereciam uma pronta resposta do judiciário. Cessar imediatamente os efeitos de uma longa jornada até a finalização de seus processos, alguns que aguardam décadas, pela satisfação de seus benefícios.
Registro que a mediação nesses casos, principalmente quando os Tribunais estiverem abarrotados de demandas dessa natureza, seria determinar o pagamento ao limite menor que requer a União, enquanto se aguarda o julgamento, em tese menos prejuízos para os beneficiários e para União, pra União, que evitaria pagamentos
a maior de juros e correção monetária, limitando-se tão somente, às diferenças, por ventura, reconhecidas.
