New Proposal for the Administrative Reform Preserves Job Security for Public Employees, but Expands Temporary Hiring and Requires Mandatory Periodic Evaluations

The Administrative Reform returned to the center of debate in the National Congress in September 2025, reigniting doubts among job candidates and public employees. The new text, presented by Deputy Pedro Paulo (MDB-RJ) to the President of the Chamber, Hugo Motta, replaces the old PEC 32, which was shelved after a strong backlash from public servants.

According to the proposal, public competitions will continue to be the main entry point to public service and job security will be maintained. However, performance will become the deciding criterion for career progression, with standardized and periodic evaluations, something unprecedented in the current model.

Who Will Be Affected by the New Administrative Reform?

According to the text under discussion, the Administrative Reform will apply to both currently active public employees and future candidates approved in competitions.

Currently, each branch adopts its own evaluation model, but the proposal anticipates the creation of at least 20 unified objective criteria, applicable to all public positions.

This means that promotions will no longer rely solely on length of service, but on meeting goals and the quality of work.

For specialists, this point could profoundly change the logic of public careers in Brazil.

How Long Will Temporary Contracts Last?

Another central axis of the Administrative Reform is the expansion of temporary contracts.

The project creates a National Register of Temporary Hiring, allowing contracts of up to 5 years, far exceeding the current 30 months in selections like those of the IBGE.

These employees would have labor rights such as maternity leave and vacation pay, but would need to serve a 12-month quarantine before being re-hired.

The model brings temporary employees closer to permanent ones, but increases turnover in the public sector.

Where Will There Be More Visible Changes?

The text also includes controversial measures, such as:

Ending 60-day vacations in the Judiciary and Public Ministry, capping them at a maximum of 30 days;

Firing judges and members of the Judiciary in serious cases, replacing compulsory retirement with salary;

Single salary cap for state-owned companies like Caixa and BNDES, equalizing them to the limit of direct administration;

Mandatory competition plan every four years, which mayors, governors, and the president will have to present within 180 days of taking office.

Additionally, the proposal limits telework: remote work will only be allowed one day a week, except for medical or family exceptions.

This contrasts with current practices, such as in the STF, where 60% of employees work remotely.

Why Does the Proposal Provide for a Unified Competition?

The Administrative Reform also introduces the Mandatory Unified National Competition (CNU) every two years.

States and municipalities could join, reducing costs for conducting their own selections.

Another innovation would be the “intra-career” competition, allowing entry into intermediate positions in specific career paths, something that does not exist today.

According to proponents of the proposal, this would standardize entry into public service and increase competitiveness, but critics argue it could diminish the autonomy of states and agencies.

For job candidates, the message is clear: competitions remain guaranteed, but permanence and progression will depend on constant performance.

Job security will not disappear, but will be linked to objective evaluations. Furthermore, the increase in temporary hiring creates a scenario in which competition for permanent positions will be even more fierce.

The Administrative Reform signals that the future public servant will need to continuously prove efficiency to maintain and progress in their position, changing the culture of the public machine in Brazil.
