The police advised the parties involved on the correct procedures in similar situations and reinforced the importance of always seeking support from the authorities in case of any doubts.
Thus, the episode ended peacefully, without further conflicts and with the certainty that the refund had been completed.
What the Law Says About Receiving Wrong Pix
Brazilian legislation is clear regarding the undue receipt of funds. The Civil Code, in its article 884, prohibits unjust enrichment and requires the return of amounts received by mistake.
Meanwhile, the Penal Code, in article 168, provides for the crime of embezzlement for those who refuse to return funds, with a sentence of one to four years in prison and a fine.
In practice, keeping a wrong pix without refund could lead to judicial blocking of the account, lawsuits, and even criminal conviction.
Furthermore, article 169 of the Penal Code establishes that appropriating someone else’s property received by mistake, accident, or force of nature also constitutes a crime, punishable by detention of one month to one year, or a fine.
Therefore, experts advise that the refund should be made immediately upon identifying the undue deposit, avoiding legal risks and further complications.
Revised Saying: “Finders Are Not Keepers, but It Can Be a Crime”
The mere receipt of a wrong pix does not constitute a crime. However, those who choose not to return the amount within the legal timeframe of 15 days engage in the crime of embezzlement.
The popular maxim “finders keepers” needs to be adapted: keeping mistakenly transferred funds is a crime, and the penalty is real. Therefore, upon noticing an undue credit in the account, the recommendation is always to contact the bank, the person who sent the amount, or directly with the authorities.
It is never advisable to spend or retain the amount, even temporarily.
How to Return a Pix Received by Mistake
Banking apps offer practical tools for returning amounts transferred by mistake. In the Pix section, there is usually a button called “Return” or “Refund,” which allows for quickly reversing the amount.
In the App Santander, for example, the process is as follows:
- Access the app and wait for ID Santander validation;
- Open the Pix statement;
- Click on the Pix received by mistake;
- On the details screen, select “Return Amount”;
- Fill in the amount to be returned, either in full or in part, justifying if necessary in the field designated for the reason;
- Confirm the return.
This procedure returns the amount to the same account that originated the transaction, ensuring traceability and security.
It is important not to send the amount to another account, even if requested by the sender, to avoid confusion or scams.
New Tool from the Central Bank: Contestation Button
Since Wednesday (1), financial institutions have made available in their apps a contention button in the Pix environment. This feature was created by the Central Bank to facilitate returns in cases of fraud, scams, or undue charges.
The resource eliminates the need to call the bank and wait for assistance. Now, the user can contest a transaction quickly and autonomously.
According to the Central Bank, the mechanism works as follows:
- The customer reports a suspicious transaction (scam, fraud, or coercion);
- The bank notifies the involved institutions;
- The balance is immediately blocked in the receiving account;
- The case is subsequently analyzed by the institutions.
In cases of fraud, the refund period is up to 11 days. For operational failures of the automatic Pix, the period is 24 hours.
The Central Bank emphasizes that this feature does not apply to common errors, such as incorrect typing of the Pix key or sending to third parties in good faith.
Role of the ABBC in the Process
According to the Brazilian Association of Banks (ABBC), the new refund mechanism is not an anti-fraud barrier, but a way to monitor occurrences and accelerate the blocking and return of resources in fraud situations.
Leandro Vilain, CEO of ABBC, emphasized that the self-service tool does not replace the user’s responsibility to guard against scams but strengthens the monitoring of transactions and the citizen’s role in the process.
The step-by-step procedure provided by the ABBC is simple:
- Open the bank’s app and look for “contest Pix” or “request refund (MED)”;
- Follow the instructions, attaching evidence such as screenshots, receipts, and messages;
- Track the contention directly in the app;
- Once verified for authenticity, the financial institution blocks the balance and refunds the amounts within 11 days.
This procedure increases the chances of recovery, as immediate blocking makes it difficult for fraudsters to quickly use the resources.
Increased Caution When Using Pix
The case in Francisco Beltrão ended peacefully but left important lessons. Returning amounts transferred by mistake is not just an ethical issue but a legal obligation.
With the popularization of Pix, the speed of transactions came with the risk of errors. In this scenario, immediate refund is essential, both to protect the sender and to safeguard the recipient.
Additionally, the new contention tools and refund mechanisms created by the Central Bank and financial institutions reinforce the need for care, transparency, and speed in resolving these cases.
