In the realm of large corporations, it is common for legal disputes to extend for years, especially when involving environmental issues.

Recently, a railway logistics company has stood out in this context, seeking to reverse penalties imposed by municipal authorities. These lawsuits raise debates about environmental responsibility and the role of companies in environmental preservation.

The Rumo Logística, responsible for operating the Malha Oeste railway that connects São Paulo to Mato Grosso do Sul, is involved in at least three lawsuits in the Court of Justice of Mato Grosso do Sul.

In these lawsuits, the company is requesting the annulment of environmental fines imposed by the Municipality of Campo Grande, totaling R$ 21.5 thousand. The infractions refer to oil spills that occurred in 2014 and 2016.

History Of Infractions

In 2014, the Municipality of Campo Grande fined Rumo Logística R$ 6,884.00 due to an oil leak at the company’s Railway Terminal in the capital of Mato Grosso do Sul.

Two years later, in 2016, a new infraction for the same reason resulted in two fines of R$ 7,340.00 each.

Although the amounts may seem modest, the company chose to contest them in court, alleging possible irregularities in the application of the penalties.

Divergent Judicial Decisions

So far, court decisions on these cases have been mixed.

In one of the actions, Judge Paulinne Simões de Souza, of the 1st Public Treasury and Public Records Court of Campo Grande, upheld the fine of R$ 6,884.00.

She stated that there are no elements justifying the modification of the administrative decision, emphasizing that the process followed all legal procedures, ensuring the company’s right to defense.

In another case, also at the 1st Court, Rumo Logística appealed after an unfavorable decision.

However, the judge denied the appeal, indicating that the company was merely seeking to reargue a matter already analyzed, which is not viable through motions for clarification.

On the other hand, at the 2nd Public Treasury and Public Records Court, under the jurisdiction of Judge Claudio Müller Pareja, the company obtained a favorable decision.

Initially, the judge dismissed the case and attempted to transfer it to the Tax Execution Court.

After Rumo’s appeal, the 2nd Civil Chamber determined that the case remain in the original court, suspending the fine and granting the company’s requests.

Environmental Responsibility And Corporate Image

Rumo Logística’s stance in legally contesting environmental fines raises questions about the socio-environmental responsibility of large companies.

While the company has the right to seek the review of penalties it considers unfair, it is essential to evaluate the impact of these actions on its reputation and relationship with society.

Companies the size of Rumo play a crucial role in environmental preservation, especially considering the extent of their operations and the influence they exert on the communities where they operate.

The adoption of sustainable practices and compliance with environmental regulations not only avoids legal sanctions but also strengthens corporate image and contributes to more balanced development.

As of January 2025, no new information has been disclosed about the outcome of these cases or any changes in Rumo Logística’s environmental policies.

The continuation of these legal disputes emphasizes the importance of transparent dialogue between companies, regulatory agencies, and society, aiming for solutions that reconcile economic development with environmental preservation.
