The Elderly Statute Brings Guarantees Ranging From Free Medications and Public Transportation Without Cost to Tax Exemptions in Specific Situations. Knowing These Rights Is Essential to Ensure Dignity, Protection, and Quality of Life in Old Age.
Brazil ensures a wide range of guarantees for people aged 60 and older.
These protections are gathered in the Statute of the Elderly (Law 10.741/2003) and related regulations, which address health, mobility, protection against violence, social inclusion, and tax benefits.
“The Statute of the Elderly is a powerful tool to ensure comprehensive protection, but many families are still unaware of the breadth of rights guaranteed by law,” says lawyer Silvana Campos, specializing in Family Law.

Right to Health and Free Medications
Older adults are entitled to comprehensive and priority care in the public health system.
The Statute determines that the Public Authority provides free medications, especially those for continuous use, as well as prostheses, orthoses, and other resources related to treatment.
When indicated by a physician, it’s possible to obtain wheelchairs, hearing aids, and similar devices through SUS.
In the medication policy, there has been significant advancement: since February 2025, the Popular Pharmacy began to offer 100% of the items on its list free of charge to the population, including drugs for hypertension, diabetes, asthma, osteoporosis, Parkinson’s disease, and glaucoma, as well as geriatric diapers for eligible individuals.
This measure complements SUS and expands access.

Free Public Transportation and Interstate Travel
The Statute establishes free public transportation in urban and semi-urban areas for individuals aged 65 and older, with identified priority seats.
Municipalities can extend free transportation starting at age 60 through local legislation.
There is also boarding priority on public transport systems.
For interstate travel, each conventional class vehicle must allocate two free seats for elderly individuals with a monthly income of up to two minimum wages.
If these seats are occupied, an elderly person with the same profile is entitled to a minimum 50% discount on the ticket price.
This rule is national and requires the presentation of a document proving age and income.
There is no legal provision for discounts on international travel.
According to Silvana Campos, “ensuring mobility is ensuring autonomy and dignity.”
Reporting Violence and Abuse
The Statute prohibits all forms of neglect, physical, psychological, property, and institutional violence.
Taking possession of the assets, earnings, or pension of an elderly person is a crime punishable by imprisonment and fines, as is withholding a bank card to control that person’s money elderly.
Reports can be made via Disque 100, a service available 24 hours a day.
In situations of immediate risk, the recommendation is to call the Military Police at 190.
Financial Protection Against Abuses
The law classifies practices such as diversion of social security benefits, withholding documents, and removing control of resources from the elderly as property violence.
“It is the duty of families, public authorities, and society to protect the elderly from financial abuses that jeopardize their subsistence and autonomy,” notes Silvana Campos.
Cases can be reported in a police report and forwarded to the social assistance network.

Respect, Priority, and Combat to Discrimination
The Statute establishes preferential treatment in public institutions and private services.
The law defines age discrimination as a crime and provides for special priority for those over 80 years old.
According to the lawyer, “respect for the elderly must be guaranteed in all spheres, from the family environment to the labor market.”
Leisure, Culture, and Inclusive Education
The law ensures access to cultural, sports, and tourism activities promoted by the public authority, along with specific educational opportunities.
It includes initiatives for literacy, digital inclusion, and universities open to seniors, which favor social integration and continuous learning.
Silvana Campos emphasizes that “encouragement of education and leisure contributes to the mental health and social inclusion of the elderly.”
Work and Tax Benefits for Elderly People
In the job market, the Statute determines that there shall be no age discrimination nor age limits for hiring, except in cases justified by the nature of the job.
The law also guides the public authority to create programs for professional reintegration.
Importantly, the Statute does not provide for automatic job stability due to age.
What exists is protection against discriminatory practices and priority in tiebreakers in competitions.
In the tax area, elderly individuals are entitled to additional income tax exemption starting at age 65, applied to retirement benefits, pensions, or retirements, up to the limit set annually by the Federal Revenue Service.
Income above this limit continues to be taxed according to the progressive table.
There is also income tax exemption for retirees and pensioners with serious illnesses, such as malignant neoplasms, severe heart disease, or Parkinson’s disease, upon medical proof.
In the case of property taxes (IPTU), the granting of exemption depends on municipal legislation, usually restricted to retirees or pensioners with low income and a single property.
In addition to these benefits, the Statute provides for reserved parking spaces, priority service, and preferential signaling in different services and spaces.
