Suape Ends Petrobras’ Monopolies on Offshore Ship Fuel Supplies

The Pernambuco Port Industrial Complex Plans to Start Offering This Service This Year, Making the Terminal More Competitive

Suape Port, located in the municipality of Cabo de Santo Agostinho, in the metropolitan region of Recife (PE), intends to offer fuel supply services for ships at sea (offshore). Throughout Brazil, only Petrobras offers this type of activity. This monopoly will be possible to break, opening the possibility for private sector participation, due to Normative Instruction RFB No. 2,109, published in October 2022.

The normative act regulates the suspension of federal taxes on revenue from sales in the domestic market and on the importation of bunker fuel intended for cabotage and port and maritime support navigation. In other words, taxes on the purchase of domestic or imported fuel by private distributors have been eliminated. This benefit was previously granted only to Petrobras.

This opening of competitiveness for fueling ships at sea had been strategically sought by Suape from the National Council of Tax Policy (Confaz). The business is expected to attract new vessels to the Pernambuco port, increasing cargo movement and vessel bunkering. Fuel distributors will have the opportunity to import bunker and store it at the port, which will generate more revenue from port fees.

From Belém do Pará to Salvador in Bahia, there are no ports with the capacity to operate fueling at sea. Thus, Suape will become a reference in this activity for large vessels that transit along the Northeast coast. Approximately 20,000 ships pass through the region each year. Now, the trend is a 40% increase in this frequency, as the opportunity for fueling adds to the measures of the BR do Mar Program, created by the Federal Government, which promotes increased cabotage supply, encourages competition, creates new routes, and reduces costs in the Brazilian navigation sector.

The Return of Autonomy and the Creation of Thousands of Jobs in Suape

The autonomy of Suape Port was restored in October 2022, marking one of the greatest achievements of the complex in recent years. This recovery allows the port itself to manage its business, providing even more speed to new ventures, which was not possible before due to Law 12,815/13 (Ports Law), which transferred the responsibility for port bidding to the federal level, removing the autonomy of Brazilian public docks, like Suape.

In 2018, Ordinance 574/2018 was enacted to regulate a provision contained in §5 of art. 6 of the 2013 Law, which allows the transfer of the preparation of the bidding notice and the conducting of bidding procedures to the port’s administration. Then, the Port Authorities Management Index (IGAP) was created, indicating that port authorities would have to reach certain performance indicators in order for the responsibilities of bidding, contracting, and contract monitoring to be delegated to those port managements.

This achievement is complemented by recent announcements of deals closed with giant companies looking to dock and/or expand their operations in the industrial complex. The green hydrogen production plant of Qair is the project with the highest investment projection at Suape Port for the future. There will be two desalination plants for utilizing seawater with an electrolysis capacity of 1 GW, with work expected to begin in 2025. About R$ 22.5 billion will be invested, generating nearly 3,000 jobs and boosting Brazil to stand out in the production of this “green gold.”

There is also great anticipation surrounding the Abreu e Lima Refinery – owned by Petrobras – which has been operating in the Suape port complex since 2014. The undertaking is set to gain new life with over R$ 5 billion in investments so that, in the future, it can be sold by the state.
