Chamber Approves PEC Exempting IPVA For Cars Over 20 Years Old. Proposal Unifies Rules Across The Country And Moves Forward For Promulgation.

The Chamber of Deputies approved this week, the PEC 72/23, which exempts the IPVA for vehicles manufactured 20 years or more .

The measure, which addresses the what, who, when, where, how and why right at the outset, was voted on in two rounds and received broad support from lawmakers. The text came from the Senate and now goes directly to promulgation, since Proposals for Constitutional Amendments do not require presidential sanction.

The change creates a single rule for the entire national territory, serving drivers who currently face different criteria depending on the state.

The proposal reached the floor to correct distortions and, above all, standardize the exemption from the IPVA for old cars, a practice already adopted in part of the country.

Chamber Approves IPVA PEC With Strong Voting Results

In the first round, the PEC recorded 412 favorable votes and only 4 against. In the second, there were 397 votes in favor and 3 against, confirming broad consensus. The exemption will apply to passenger cars, pickups and mixed vehicles. However, minibuses, buses, trailers and semitrailers are excluded from the new rule.

According to the rapporteur, deputy Euclydes Pettersen (Republicanos-MG), the measure avoids inequalities in charging:

“We have standardized the IPVA exemption for old cars, avoiding differences between states,” he stated.

States Will Be Impacted Differently By The Approval Of The PEC

The approval of the PEC will particularly impact states that still do not exempt old vehicles, such as Minas Gerais, Pernambuco, Tocantins, Alagoas and Santa Catarina. Currently, each state determines when a vehicle becomes exempt, with deadlines ranging from 10 to 30 years — and, in some cases, there is no exemption.

With the new rule, this autonomy ceases to exist, as the immunity becomes constitutional. Thus, all states will have to follow the same standard.

IPVA PEC Emerges After Tax Reform And Changes The National Scenario

The proposal emerges after the 2023 tax reform, which redefines the rules of the IPVA and expands its charging to recreational water and aerial vehicles.

The Constitution already guarantees immunity for agricultural aircraft, professional vessels, agricultural machinery and platforms used in the oil and gas industry.

Now, with the new PEC, cars over 20 years old are included in this group of immunities, creating a standardized national policy.

Deputies Advocate For The Exemption For Old Cars

During the vote, lawmakers from different parties advocated for the PEC.
The deputy Hildo Rocha (MDB-MA) highlighted that states like Maranhão already adopt similar exemptions.
Meanwhile, deputy Domingos Sávio (PL-MG) emphasized the social impact:

“The PEC helps less fortunate citizens who cannot afford to buy new cars.”

The rapporteur also argued that many owners have already paid significant taxes over the years, and therefore, the exemption corrects a historical distortion.

Next Steps: PEC Will Be Promulgated And Automatically Applied

As it is a Constitutional Amendment, the PEC does not need presidential sanction. After approval in two rounds by the Chamber and the Senate, the next step is only the promulgation in a session of the National Congress.

After that, the rule will come into force automatically across the country. States will have to adjust their internal regulations, but will not be able to create exceptions or try to maintain the charging, since the immunity becomes constitutional — and, therefore, mandatory.

The expectation is that the promulgation will occur in the coming weeks, consolidating the definitive exemption of the IPVA for vehicles over 20 years old.
