Municipal Charging Creates New Fee for Tourist Vehicles, Defines Values by Category, Foresees High Fines in Case of Fraud and Establishes Exemption Rules and Monthly Limits, While City Hall Prepares Regulation and Electronic System for Beginning of Inspection.
Guarujá, on the coast of São Paulo, approved the creation of an Environmental Preservation Fee (TPA) charged per day of vehicle stay in the municipality, with a cap of 15 days per month.
The measure was instituted by Complementary Law 346/2025, published in the Official Gazette of the Municipality on December 11, and still depends on regulation to come into effect.
The charge will be directed to the vehicle owner, with the possibility of joint liability of the possessor or driver.

According to the City Hall, the TPA is still in the phase of technical definition and there is no set date for commencement.
The Executive also informed that the fee will not be in effect during the summer season 2025/2026.
Fee Value and Calculation by Type of Vehicle
The value of the TPA is defined in Guarujá Fiscal Unit (UFG), a municipal indexer.
The law establishes brackets by category and charges per day, with differentiated values.
For 2026, a municipal decree set the fiscal unit at R$ 4.86.
With this parameter, the daily charge provided in the legislation is R$ 7.29 for motorcycles, equivalent to 1.5 UFG.
Passenger vehicles with up to eight seats will pay R$ 19.44 per day, corresponding to 4 UFG.
Vans, utility vehicles, and pickups will have a daily charge of R$ 38.88, or 8 UFG.
Minibuses will pay R$ 97.20 per day, a value equivalent to 20 UFG.
At the highest level, buses and trucks will pay R$ 145.80 per day, corresponding to 30 UFG.
In all cases, the monthly limit of 15 days per vehicle will be respected.
The law also provides that the charge will be proportional to the length of stay, which will depend on the electronic system to be implemented by the City Hall.
Regulation Defines When the Fee Starts to Be Collected
Although the law is already in effect, the TPA can only be effectively collected after a series of administrative steps.
Among them is the regulation by the Executive Power, which must occur within 90 days from the publication date.
This regulation needs to define the operational structure of the management system, the electronic control methods and the rules for registration, maintenance, and renewal of exemptions.
Mechanisms for accountability, inspection, audit, and social control must also be established.
If the execution of the TPA is delegated to third parties, the regulation must indicate the additional obligations of the concessionaire.
After that, the draft regulation must undergo public consultation for a minimum period of 15 days.
The charge can only begin after the official publication of the rules and confirmation of the functioning of the electronic system.
In a statement, the City Hall informed that the TPA is in the process of regulation and defining the necessary technical procedures.
“There is still no set date for the commencement of the charge.”
Destination of Resources Collected with the TPA
All funds collected from the fee will be allocated to the Municipal Fund for Sustainable Tourism (FMTS).
The fund was created to finance projects, programs, and actions aimed at tourism and environmental sustainability in the municipality.
The legislation requires the publication of a semiannual report with data on revenue and allocation of funds.
This report must be available on the City Hall Transparency Portal.
The law also prohibits the use of resources for administrative expenses that are not foreseen in the legal text itself.
Payment, Interest, and Penalties Provided for in the Law
Payment of the TPA may be made through app, website, QR Code, or accredited locations.
The deadline for payment will be up to 30 days after the vehicle’s entry into the municipality.
In case of delay of up to 30 days, a 10% late fee will be applied to the amount owed.
If the delay exceeds this period, the penalty increases to 20% of the owed amount.
Additionally, there will be a charge of 1% interest per month, calculated on the updated amount.
The debt may also be registered in Active Debt.
In cases of fraud or dishonesty, the legislation provides for an additional penalty of up to 100% of the owed amount.
This penalty can, in practice, double the amount of the charge, adding to the principal debt.
Automatic Exemptions and Cases That Require Prior Registration
Some vehicles are automatically exempt from the TPA charge.
Among them are ambulances, official vehicles, police vehicles, and fire department vehicles, as well as vehicles from essential public service concessionaires in technical assistance.
Vehicles of persons with disabilities with state exemptions and authorized urban and road collective transport are also included in this category.
Other exemptions depend on prior registration or completed within 72 hours after entering Guarujá.
These cases include:
- Vehicles of residents in Guarujá, limited to up to four per residence.
- Vehicles of property owners in the municipality, with up to two per unit.
- Vehicles of workers with active links in Guarujá, limited to one per person.
- Vehicles for essential supply.
- Vehicles for authorized local school and tourist transport.
- Vehicles licensed in municipalities of Baixada Santista.
- Vehicles in swift transit, with a stay of less than four hours, except buses, minibuses, and vans.
- Vehicles intended for commercialization, brought for exhibition, sale, or rental in local dealerships or stores.
- Trucks used for transporting cargo from residents of the municipality.
- Vans, buses, and minibuses intended for emission tourism transport, with duly authorized entry.
Charging Tourists Advances in Other Cities on the Paulista Coast
While Guarujá organizes its regulation, other cities on the coast of São Paulo are adopting similar measures.
Ilhabela, for example, began charging a tourist fee in December, with its own values and rules.
With the charge still conditioned to regulation, public consultation, and the implementation of the electronic system, the main question for residents and visitors remains open: how will the City Hall ensure an efficient, transparent, and proportional charging system without creating barriers to access to the city?
