Agriculture Committee Approves PDL 348/25 to Suspend Decree 12,527/25, Review Rules of the Defeso Insurance and Preserve Benefit During Fish Reproduction for Registered Artisanal Fishers in the RGP
The Agriculture, Livestock, Supply and Rural Development Committee of the Chamber of Deputies approved PDL 348/25, which suspends changes to Decree 12,527/25 regarding the defeso insurance, a benefit paid to artisanal fishers during the fish reproduction period, due to significant social and economic impact.
Approval of the Project in the Thematic Committee
The committee approved the suspension of the changes to the defeso insurance, which works like unemployment insurance for professional artisanal fishers during the defeso period, a mandatory halt in fishing for environmental preservation.
The questioned changes were established by Decree 12,527/25 and include the requirement for uninterrupted exercise of fishing activity and registration update in the General Register of Fishing Activity.

Author’s Criticism of the Application of the New Rules
The author of the PDL, Deputy Silas Câmara, stated that the changes harm registered fishers in the RGP, affecting access to professional credentials and social or assistance benefits.
Silas Câmara also criticized the approval of professional registration by municipal governments, stating that municipalities do not have sufficient staff to meet the demand of professionals.
Evaluator’s Assessment on Legal and Social Risks
The evaluator, Deputy Albuquerque, assessed that the norm imposes risks of undue rights restriction, challenging the principle of legality and characterizing a potential social setback.
According to Albuquerque, the defeso insurance is a social and food protection instrument during the mandatory halt, being essential for the survival of families and communities dependent on fishing.
Impact of the Benefit on Income and Environmental Preservation
The evaluator argued that any measure that compromises the continuity of the benefit directly affects workers in a situation of economic vulnerability, with immediate repercussions on local food security.
The defeso insurance also serves as a mechanism to support environmental preservation, by ensuring income during the fish reproduction period and reducing pressure on stocks.
Proceedings and Next Legislative Steps
The proposal will proceed for analysis by the Committee on Constitution, Justice and Citizenship and, subsequently, for voting in the Plenary of the Chamber of Deputies.
To come into effect, PDL 348/25 needs to be approved by the Chamber and the Senate, maintaining the suspension of the rules of Decree 12,527/25.

O que esta acontecendo nos últimos anos é uma falta de respeito com o pescador (a) artesanail, os nossos direitos não estão sendo respeitados , no período do defeso estamos fazendo nossa parte mas o governo federal nao esta fazendo a dele , ultimamente muitos decretos e muitas mps para dificultar ainda mais a um acesso adquirido por lei que é o seguro defeso, seguro esse que deveria ser pago durante a paralisação da Pesca, o que só ocorre quase no final. Trazendo instabilidade e dificuldades financeiras ao pescadora) artesanal.
Sou pescadora da cidade de Uruguaiana RS,isso que estão fazendo com agente é um descaso e uma falta de respeito com o povo que depende da pesca para sobreviver,e aqui tbm estamos com nossos defesos atrasados até agora nenhuma parcela foi liberada e as contas estão chegando e nosso dinheiro que é por direito nosso até agora nada 🤔😡🤬
Sou pescadora e pesco pra comer , acho tudo isso um absurdo,esses deputados tudo vão ter comida na mesa no natal e nos pessoas humilde não, agora o nosso pagamento atrasado, e ainda querem proibir da gente pescar nossos filhos vão comer oq gente.
