Former Employee of TJCE Accused of Illegally Increasing Own Salary by Almost 50%. MP Seeks Conviction and Repayment.

A former employee of the Court of Justice of Ceará (TJCE) has been charged by the State Prosecutor’s Office of Ceará (MPCE) for allegedly illegally increasing her own salary, causing harm to public funds.

The case occurred between January and April 2023, in Fortaleza, when the then-server allegedly used, without authorization, a colleague’s password to alter her remuneration. The investigation indicates an increase of almost 50% in salary, a practice considered a crime against public administration in Brazil.

According to the MPCE, the conduct resulted in a total loss of R$ 22,614.67 to TJCE. Therefore, in addition to the criminal charge, the agency demands that the former employee fully repay the amount if convicted. The case is now pending judicial review.

How the Salary Increase Allegedly Occurred, According to the Complaint

According to the Prosecutor’s Office, the former employee of TJCE allegedly exploited unauthorized access to the court’s internal system. To do this, she used a colleague’s password without permission.

With this access, the server is believed to have altered internal data related to her own remuneration. Thus, the salary was irregularly increased, without legal or administrative backing.

Meanwhile, the amounts continued to be paid monthly, which ultimately accumulated the loss pointed out in the investigation.

MPCE Details Loss to TJCE’s Public Funds

The MPCE calculated a direct financial impact of R$ 22,614.67 and classified the amount as significant due to involving public resources. According to the agency, these resources should finance the regular functioning of the Judiciary.

Furthermore, the Prosecutor’s Office warned that such practices undermine society’s trust in public institutions. For this reason, the agency prioritized the investigation of the case.

On a national level, authorities have intensified the fight against situations of illegal salary increases involving public servants in Brazil, especially when there is misuse of official systems.

Administrative Process Led to Exoneration of Former Employee

After becoming aware of the case, the Court of Justice of Ceará initiated a disciplinary administrative process and conducted an internal investigation. During this period, the technical team analyzed access records and verified the transactions made in the system.

Upon concluding the procedure, the TJCE decided to exonerate the former employee, who held a commissioned position at the time of the incidents. Subsequently, the court informed the Prosecutor’s Office to deepen the criminal investigation.

Thus, the case moved from the administrative sphere to the judicial.

MP Requests Classification for Embezzlement and Increased Sentence

In the formal complaint, Prosecutor Igor Pinheiro requested the classification of the former employee for the crime of embezzlement. This crime occurs when a public servant misappropriates or diverts goods or funds belonging to public administration.

Additionally, the MPCE requested an increase of one-third of the sentence and argued that the accused held a commissioned position, which aggravates the conduct.

According to the prosecutor, the former employee used her position to gain undue financial advantage, which justifies the request for harsher punishment.

Repayment of Salary May Be Required if Convicted

If the court finds the former employee guilty, she will have to repay the full amount she diverted from the TJCE. This restitution represents an essential measure to repair the damage caused to public funds.

In addition to repayment, sentencing may result in imprisonment, as provided by Brazilian law for crimes against public administration.

Therefore, the outcome of the case may serve as a warning to other public servants in Brazil about the consequences of misuse of systems and illegal salary increases.

Case Reinforces Debate on Internal Control in the Judiciary

Finally, the episode reignites the debate on the need for more stringent internal controls in public agencies. Experts point out that the shared use of passwords remains a vulnerable point in many institutions.

Meanwhile, TJCE states it is cooperating with investigations and strengthening security measures. The goal, according to the court, is to prevent similar cases in the future and preserve the credibility of the Judiciary.
