A proposal advancing in Congress could change the driver's license renewal process nationwide, requiring a psychological exam for all drivers and preventing anyone who fails the test from driving, if sanctioned.

The requirement of psychological assessment at all stages of driver's license renewal has advanced in Congress and can reach all drivers, not just professionals.

O PL 4111 / 2023, originating from Senate, is in conclusive processing in the Chamber of Deputies, after approval by the Road and Transport Committee (CVT) in August 2024; the text awaits deliberation by the Constitution, Justice and Citizenship Commission (CCJC).

If it becomes law, anyone who fails the exam will not have the wallet renewed and, without a valid driver's license, you will be prevented from driving until a new evaluation and approval.

What changes for the driver

Today, psychological evaluation is mandatory in first license and, in renewals, only for those who exercise paid activity at the wheel.

The proposed change extends the requirement to all drivers at the time of renewal, along with the physical and mental fitness test.

With this, the step would be included in the flow of Detrans, with scheduling, execution and recording of the result in the driver's record.

Detailed regulations, such as technical parameters and frequency combined with ages and the validity of the CNH, will be the responsibility of the counter if the project is approved.

Today, Resolution 789/2020 Contran provides for psychological evaluation when obtaining a driver's license, when renewing only for those who carry out paid activities, when replacing a foreign document and at the expert's request.

Current progress of the project

The text was born in PLS 98 / 2015, authored by Senator Davi Alcolumbre, and was approved in final decision at the Senate CCJ on August 9, 2023.

The proposal then went to the Chamber.

On August 14, 2024, the CVT approved a favorable opinion and referred the matter to the CCJC.

On December 11, 2024, the rapporteur in the CCJC, deputy Hugo Leal, presented an opinion on constitutionality and good legislative technique.

On April 9, 2025, the committee withdrew the project from the agenda at the request of the rapporteur, and the most recent recorded status remains as “ready for the agenda” at the CCJC.

As it is being processed conclusively, the proposal can be approved by the committees and proceed to sanction, unless an appeal is made to a vote in the Plenary.

Failure in the psychological exam

If the psychological evaluation becomes a requirement for renewal and the driver fails, the CNH will not be renewed.

In the absence of a valid document, driving with a license that has been expired for more than 30 days é very serious infraction, subject to fine and vehicle retention until a qualified driver is presented.

In practice, until a new assessment is passed and the driver is renewed, they are prevented from driving.

The rule arises from the article 162, section V, of the Brazilian Traffic Code (CTB), already in force.

Operational and financial impacts

Adopting the exam for all renewals would create an additional mandatory step, with an impact of time e cost to the driver, in addition to the need for calendar in accredited clinics.

Currently, procedures and accreditations are governed by Contran regulations and implemented by state Detrans; any expansion of the public would require adjustments to schedules and service capacity.

The definition of values ​​is not in the project and depends on state policies and the accredited network.

Operational details — deadlines, flows and systems — will only be fixed in subsequent regulation, if the proposal is approved.

Arguments and justifications

The project's justification maintains that the emotional condition of the driver varies over time and that periodic reassessments can reduce risks on the roads.

In the Senate, the report was by Senator Fabiano Contarato, with a favorable opinion and approval in the CCJ.

In the Chamber, the CVT also approved the text, highlighting the role of psychological assessment in the set of road safety measures.

The CCJC, in turn, limited itself to analyzing constitutionality, legality and legislative technique.

Position of entities and experts

Traffic and Psychology follow the theme.

O Federal Council of Psychology (CFP) advocates expanding the assessment to all renewals, arguing that subjective factors evolve and can influence driving behavior.

Official communications and informational materials from the council indicate support for the measure and record the project's progress since 2023.

Next steps in Congress

Without a final vote in the CCJC until the last official registration, the project continues pending agenda.

If the committee approves without changes to the merits, the proposal may go to presidential sanction directly. If there are any changes, it returns to the Senate for review.

In any scenario, the Implementation will require Contran to issue acts to detail procedures, deadlines and technical criteria in order to integrate psychological assessment into the license renewal cycle throughout the country.
