The Committee on Transportation And Transport Approved A Proposal That Amends The Brazilian Traffic Code By Requiring Drivers To Reduce Speed To 60 Km/h Or To The Limit Of The Road In Medical Services And Construction, Providing Fines For Violations And Mandatory Lane Changes Whenever Possible

The Committee on Transportation and Transport of the Chamber of Deputies approved, in December, a proposal that requires drivers to reduce speed to 60 km/h or to the speed limit, if lower, in situations of medical service or construction, amending the Brazilian Traffic Code and establishing new penalties.

According to the approved text, the driver must reduce speed to 60 km/h or to the maximum permitted on the road, if less, whenever there is a medical service or construction on the road. The rule aims to standardize conduct in operational risk scenarios on highways.

In addition to reducing speed, the driver must change lanes whenever possible, maintaining a safe distance from vehicles and people involved in the service or execution of the work, enhancing the predictability of traffic in these areas.

Penalties Vary According To The Conduct Of The Driver

Failure to comply with the guidelines will be classified as a serious violation when the driver fails to reduce speed. Failing to change lanes or maintain a safe distance will constitute a medium violation, both punishable by a fine.

The differentiation of penalties has been structured to reflect the degree of risk associated with each behavior, according to the text approved by the committee.

Rapporteur Presents Amendment To Bill 4511/24

The approved text is the amendment from the rapporteur, deputy Diego Andrade (PSD-MG), to Bill 4511/24, authored by deputy Gilberto Abramo (Republicans-MG).

According to the rapporteur, the amendment preserves the central purpose of the proposal and corrects technical imperfections that could hinder its practical application, adjusting the wording for greater operational clarity.

Justification Cites Accidents And International Experiences

In the rapporteur’s assessment, the increase in accidents involving professionals on highways and the need to modernize the Brazilian Traffic Code in line with international experiences support the approval of the measure.

He stated that the proposal represents an important advancement for Brazilian traffic, reinforcing safety in critical situations of service and construction.

Proceedings Follow For Conclusive Analysis

The proposal will still be analyzed, in a conclusive manner, by the Committee on Constitution and Justice and Citizenship. To become law, the text needs to be approved by the Chamber and the Senate, following the regular legislative process. Minor adjustments may occur at this stage.
