Proposal Sets Cap of R$ 46 Thousand, Prohibits 60-Day Vacations and Creates New Requirements for Public Competitions and Server Evaluation.
The Administrative Reform PEC was presented with the promise of transforming the structure of public service in Brazil. The text provides for the end of so-called super salaries above the constitutional cap, which is currently R$ 46,4 thousand, and limits additional benefits that inflated the remuneration of certain careers.
According to the Estadão portal, the proposal also establishes new rules for vacations, public competitions, performance evaluations, and commissioned positions, in addition to imposing spending limits on different powers. The expectation is that, if approved, the reform will profoundly change the management of public service at the federal, state, and municipal levels.
Super Salaries Under Pressure
One of the central points of the Administrative Reform PEC is the restriction on super salaries.

The proposal prohibits the use of indemnity funds as a way to exceed the cap, a common practice in some careers within the Judiciary and the Public Ministry.
Allowances such as food, health, and transportation remain permitted, but will be limited to up to 10% of the remuneration when the server is already near the cap.
Moreover, the retroactive payment of these amounts can only occur with a definitive court decision.
The intention is to eliminate the so-called “add-ons” that inflated salaries and created distortions within public service, in a move to contain spending and seek greater equity.
Limited Vacations and Benefits
Another target of the PEC is extended vacations, such as those of 60 days, currently granted to judges and members of the Public Ministry.
The new rule sets a maximum limit of 30 days for most careers, except for teachers and healthcare professionals who work in high-risk situations.
The text also prohibits the creation of new benefits without congressional approval and forbids automatic raises based solely on years of service.
With this, the government aims to curb the expansion of internal privileges created by oversight bodies without the participation of the Legislative Branch, something common in previous years.
Performance Evaluation and Career Progression
The Administrative Reform PEC establishes mandatory performance evaluations for all public servers, both during the probationary period and throughout their career.
If ineptitude is identified, the server may be dismissed during the initial period.
Salary progressions and the granting of bonuses will depend on the results obtained in these evaluations, aiming to align remuneration and efficiency in the provision of public services.
The measure is seen as an important step to modernize administration and increase the productivity of public servants.
Competitions and New Hiring Models
To open public competitions, a prior assessment of the workforce will be required, ensuring that hires meet real demands.
The text encourages the creation of cross-cutting careers, such as public policy analysts and infrastructure specialists, who can work across different agencies.
Another innovation is temporary hiring through competition, referred to as “fixed-term occupation of effective position.”
In this model, the server works for at least 10 years in transitional functions, without generating a permanent link. The proposal seeks to provide flexibility to the State while maintaining merit-based selection criteria.
Limits on Commissioned Positions and Public Spending
The PEC also restricts the occupancy of commissioned positions: a maximum of 5% of the total may be designated for political appointments, a number that can reach 10% in small municipalities.
At least half of these positions must be filled by career servers.
Another highlight is the spending cap for the Judiciary, Legislative, and State and Municipal Public Ministries, limited to 2.5% of real growth per year starting in 2027.
The Union and local governments will still have to conduct ongoing spending reviews, reallocating resources according to priorities established in strategic management plans.
