Detrans Admit That The Law Needs To Be Followed, But Say It Can’t Be Applied “Instantly”; The Government Dismisses Deadlines And Maintains The New Driver’s License

The so-called driver’s license without driving school, as the change in the process for obtaining the first license has become known, is already in effect throughout Brazil.

The new rule allows the operation of independent instructors without ties to driving schools, within the framework established by law.

With the enactment, the issue has sparked controversy and opened a public dispute between ANIT (National Association of Independent Instructors) and the Detrans.

Accusation of “Boycott” And Difficulty In Registration

ANIT claims that Detrans are creating barriers to register new professionals, which the organization describes as a kind of “boycott” against the changes.

According to the association, state agencies have been making it difficult to register the independent instructors authorized by legislation.

In a message quoted by columnist Paula Gama from UOL, ANIT stated that “Detrans are putting obstacles to prevent CNH Brazil from developing.”

The implementation of the driver’s license without driving school has become a dispute between states and the federal government, and the lack of standardization has left candidates and independent instructors without clear guidance on the next steps.

Response from Detrans: “New Model” Requires Structure

State agencies responded through a statement and denied any boycott.

The justification presented is that this is a new format, which will require preparation, accreditation, and monitoring to function fully.

In the view of the Detrans, the implementation could not occur automatically, even though the law is already in effect.

Request for 180 Days And Reaction from The Federal Government

Cetrans from São Paulo and Paraná requested a 180-day deadline to adapt to the changes related to the driver’s license without driving school.

The argument is that time would be necessary to adjust procedures and internal structures before putting the model into practice.

However, the initiative was not well received by the Federal Government or by Senatran (National Traffic Agency).

Senatran Says There Is No Deadline And Rules Are Already In Effect

The Federal Government maintains that there is no “vacancy period” in the law and that the measures need to be adopted immediately.

Adrualdo Catão, the national traffic secretary, also stated that the Cetrans do not have the legal authority to grant such a deadline.

Thus, according to the federal position, the changes are already in effect throughout the country.

Citizen Faces Uncertainty And Conflicting Information

The divergence between the association, state agencies, and the federal government fuels a scenario of doubts about how the new process will be implemented in practice.

As the discussion continues, those trying to start the path to their first license face a lack of clarity and conflicting guidance.

The dispute also tends to influence the next steps, with pressure for standardization and clearer operational rules in the states.
