The New Resolutions of Antaq Regarding Inland Navigation in National Territory Established New Rules and Rights for Passengers in Transportation Operations and Opened New Guidelines for Transportation Services Provided by National Companies.
During the publication of the Official Gazette of the Union (DOU) on Thursday, (07/07), the National Agency for Waterway Transportation (Antaq) published three new resolutions regarding inland navigation in Brazil. The first one deals with the guidelines for transport services provided by companies in the country, while the second concerns the duties and rights of passengers in transportation and, finally, the last one addresses private transportation operations to facilitate these activities.
New Antaq Resolution Regarding Transportation Services in Inland Navigation Determines Which Companies Can Carry Out These Activities in Brazil
Antaq announced new resolutions regarding inland navigation processes in Brazil, that is, those carried out in channels, rivers, lakes, coves, bays, and creeks of the country. The first is resolution n.º 80, which concerns the criteria and procedures for granting transportation services, vessel registration in the Merchant Marine System, and chartering vessels for interstate, international, and domestic inland navigation.
Thus, the new Antaq resolution determined that only companies licensed by the agency may provide inland navigation operation services in Brazil. Accordingly, the agency issues licenses for services such as: regular transportation of passengers and vehicles in longitudinal routes; regular transportation of passengers and vehicles in ferry routes; private transportation of consolidated cargo; or private transportation of cargo, people, and vehicles.

The main goal of this resolution is to clarify the agency’s role in regulating these services and facilitate the licensing of transportation companies.
Additionally, Antaq also determined regarding inland navigation transportation services that it is sufficient to request certification in the Merchant Marine System from Antaq, presenting the required documentation as per the regulation, for companies that operate exclusively in the transportation of cargo within intermunicipal or municipal inland navigation. Finally, the transportation service resolution states that the authorization for chartering activities may only occur unilaterally by the agency.

In addition to resolution n.º 80, Antaq also published two other resolutions regarding inland navigation in Brazil. The first is resolution n.º 81, which addresses issues related to passengers in transportation services in the country.
Among the main points highlighted in the resolution are respect, accessibility, and courtesy in serving passengers, adequate and clear information about the services provided, and compliance with arrival and departure schedules. Thus, Antaq anticipates an improvement in the transportation of people within the country’s inland navigation.
The rights to benefits set forth in the law are also present in the resolution, including the right of a child accompanied by a legal guardian to obtain a free ticket or a 50% discount, depending on the child’s age. Lastly, elderly individuals over 60 years of age are also entitled to a 50% discount on tickets, as well as the possibility of two seats on the vessel, ensuring greater comfort.
The final resolution published was resolution n.º 82, which concludes the matter of inland navigation by addressing private transportation. It discusses the duties of the service provider, such as allowing and facilitating free access and oversight by Antaq agents and observing the regulations established by the agency in the authorization term.
