CGU Audit Reveals Post-Mortem Contracts, Unauthorized Refinancings, and Thousands of Operations with Abnormal Interest Rates, Leading INSS to Suspend New Averbações from Agibank While It Investigates Possible Irregularities.

The National Institute of Social Security (INSS) suspended indefinitely the receipt of new payroll credit averbações submitted by Agibank S/A, after an audit pointed to signs of large-scale fraud involving retirees and pensioners.

The measure, taken this Tuesday (2), prevents INSS beneficiaries from contracting new payroll loans from the bank while the investigation is ongoing.

The decision is based on a report from the Federal Audit Office (CGU), which identified contracts made in the name of deceased individuals, unauthorized refinancings, and thousands of operations with interest rates registered well below the market standard.

The case has been forwarded to the Federal Police and to the INSS’s own Corregedoria, which has opened an administrative process to deepen the investigation.

Why INSS Suspended New Payroll Loans from Agibank

According to an official statement released by INSS, the suspension affects new payroll credit averbações sent by Agibank to the agency’s system.

The agency states that the CGU audit found “a significant number of averbações without the express consent of the beneficiaries”, in addition to signs of irregularities spread over thousands of the bank’s operations.

The measure does not have a defined deadline for termination.

INSS indicated that the suspension will remain in effect until the conclusion of the administrative process that will analyze the audit findings, ensuring a full defense and contradiction to the bank.

The announcement does not address blocking benefits nor mention immediate reviews of already contracted loans, focusing on the interruption of new payroll credit contracts sent by Agibank for averbação.

Among the irregularities considered most serious by INSS and CGU is the existence of 1,192 payroll credit contracts signed after the date of death of the beneficiaries, in the period from 2023 to 2025.

Within this group, 163 contracts were linked to benefits that had already been terminated in the INSS systems, indicating strong suspicion of fraud.

These contracts in the name of deceased individuals are pointed out as potentially harmful practices to retirees, pensioners, and their dependents.

Unauthorized Refinancing in Fortaleza

The audit also detailed a specific case in Fortaleza (CE), used as an example of the pattern of irregularities found.

One beneficiary had their debts refinanced without request or authorization, in an operation recorded on November 7, 2025.

This refinancing included seven contracts, three of which did not exist in INSS’s systems, but were added to the outstanding balance.

These non-existent contracts added R$ 17,073.94 to the remaining amount.

The system also indicated a “change” of R$ 17,135.18, an amount close to the total of the fraud, which was never credited to the beneficiary.

This case reveals a type of refinancing that conceals the inclusion of non-existent contracts, increases the indebtedness of the insured, and registers amounts that are not transferred to the benefit holder.

Interest Rates Below 1% Raise Suspicions

Another point that drew CGU’s attention was the record of refinancing operations with rates much lower than the maximum allowed for INSS payroll loans, currently at 1.85% per month.

In an initial test, auditors found 5,222 contracts with rates lower than 0.4% per month.

In a broader analysis, 33,437 contracts with interest below 1% emerged, a figure considered incompatible with market reality.

The suspicion is that these reduced rates may have been recorded only in the system, without reflecting the real conditions of the loans, to prevent control mechanisms from generating alerts.

Investigation with the Federal Police and Positioning of Agibank

INSS communicated the referral of the case to the Federal Police and to the agency’s Corregedoria, which will deepen criminal and administrative investigations.

The suspension of new averbações will remain in effect until the process is concluded.

Agibank states that it was informed of the decision without prior notice and without a prior opportunity for defense.

In a statement, the bank said it “is unaware of irregular contracts” and stated that it follows strict security protocols, such as facial biometrics, documentation checks, and cross-referencing of official data.

The institution informed that it requested access to the case files and that, if irregularities are confirmed, it will adopt internal measures to correct procedures, absorbing any losses “without any cost to clients or to INSS, with full reimbursement of the amounts involved”.

The bank emphasized that the other services remain operational as usual.

History of Tension between INSS and Agibank

The current suspension comes just a few months after another episode involving both institutions.

In August 2025, INSS suspended the contract with Agibank responsible for payment of pension benefits to investigate reports of diversion of calls from Central 135 to the bank’s application, refusals of portability, and undue retention of amounts.

At the time, INSS classified the investigated practices as very serious infractions, as they interfered with access to the official service channels.

Agibank denied any diversion and stated that it complied with the agency’s regulations.

In November, after signing a commitment agreement, the contract was reinstated.

With the new CGU audit, the relationship is once again facing significant strain.

What Changes for Retirees and Pensioners

In practice, the decision prevents retirees and pensioners from INSS from contracting new payroll loans from Agibank, since the bank cannot send new contracts for averbação.

Those who already have active payroll loans have not had changes announced so far.

INSS focused the announcement on the interruption of new operations during the investigation.

Beneficiaries who wish to contract payroll credit can turn to other authorized institutions.

The agency advises that doubts and complaints be registered with Central 135 or Meu INSS, especially in cases of unrecognized deductions.

In light of this scenario of suspicions regarding post-mortem contracts, unauthorized refinancings, and possibly manipulated interest rates, how many retirees and pensioners will need to review their statements to check for unauthorized deductions?
