INSS Waives Waiting Period for 17 Serious Illnesses; Insured Individuals Have Immediate Right to Sick Leave Benefits and Disability Retirement, with Lifelong Income in Some Cases.

The fear of not being able to work while facing the bureaucracy of the INSS is a reality for millions of Brazilians. However, social security legislation provides special protection: there is a list of 17 serious illnesses that entitle individuals to immediate benefits, without the need to fulfill the usual requirement of 12 contributions.

In practice, this means that upon being diagnosed with one of these conditions, the insured can request sick leave benefits or disability retirement, ensuring income even in times of extreme vulnerability.

What Does Waiting Period Exemption Mean in the INSS

As a rule, to receive disability benefits, such as sick leave benefits, the worker must have made at least 12 monthly contributions to social security. This minimum period is called the waiting period.

However, for serious cases, the law makes an exception: the waiting period is waived. It is enough to prove the status of the insured and a medical diagnosis of one of the listed diseases. This rule is stated in Article 151 of Law 8,213/91 and was regulated by Interministerial Ordinance No. 22/2022.

What Are the 17 Diseases That Grant Immediate Rights

The list includes conditions that, due to their severity, significantly impair the individual’s ability to work:

  1. Active tuberculosis
  2. Leprosy
  3. Mental alienation
  4. Malignant neoplasm (cancer)
  5. Blindness
  6. Irreversible and debilitating paralysis
  7. Severe heart disease
  8. Parkinson’s disease
  9. Ankylosing spondylitis
  10. Severe nephropathy
  11. Advanced stage of Paget’s disease (deforming osteitis)
  12. Acquired immunodeficiency syndrome (AIDS)
  13. Contamination by radiation, based on conclusions from specialized medicine
  14. Severe liver disease
  15. Multiple sclerosis
  16. Acute stroke
  17. Acute surgical abdomen

All these conditions waive the waiting period and grant direct access to social security benefits.

Sick Leave Benefits: Temporary Support for Recovery

The sick leave benefit is paid when the incapacity is temporary. The insured diagnosed with one of the diseases on the list can request the benefit immediately, without needing to prove 12 months of contribution.

The amount is calculated based on the worker’s salary average, ensuring a subsistence income during treatment and recovery.

Disability Retirement: Lifelong Income in Permanent Cases

When the incapacity is permanent and there is no prospect of returning to work, the insured can request disability retirement (now known as retirement due to permanent incapacity).

In this case, the benefit may be lifelong, guaranteeing a stable income until the end of the insured’s life. In specific situations, such as work accidents or serious illnesses, the retirement can reach 100% of the salary average.

How to Request Benefits from the INSS

The process is relatively simple:

  • The insured must gather medical reports and exams that prove the diagnosis of the illness.
  • The request can be made through the app Meu INSS, the website, or by phone at 135.
  • In some cases, even without a waiting period, a medical examination may still be necessary to confirm the incapacity.

The significant difference is that once the serious illness is proven, the right to benefits is immediate, without the requirement for the minimum contribution period.

The Social Impact of the List of Serious Illnesses

The waiting period exemption rule is a form of social justice, as it protects those facing more severe conditions.

For thousands of families, it represents the difference between being left unprotected or having a minimum of financial stability in a critical moment.
