New Rule Is Already in Effect in Porto Alegre: EPTC Will Suspend Drivers’ CNH for Speeding Without Having to Go Through Detran
A new rule is already in effect in Porto Alegre and drivers need to pay extra attention when stepping on the gas. Since July 14, Monday, an important change in the traffic of the capital of Rio Grande do Sul is expected to catch many by surprise: the EPTC itself will be able to suspend the CNH of anyone caught driving at high speed, and the process will be direct, without needing to go through Detran.
That’s right, anyone caught driving over 50% of the maximum speed limit on the road will have the process of CNH suspension initiated by EPTC itself (Public Transport and Traffic Company), without needing authorization or transfer to Detran-RS.
The new practice is legally supported by the article 218, item III of the Brazilian Traffic Code, and aims to accelerate the response of authorities to dangerous infractions. Previously, this penalty was only applied by Detran, which could delay the processing significantly.

According to the CTB, anyone exceeding the speed limit on the road by more than 50% commits a very serious infraction, which in addition to the fine of R$ 880.41, can lead to the immediate suspension of the right to drive.
EPTC Will Pursue Reckless Drivers More Quickly
According to the president of EPTC, Pedro Bisch Neto, the decentralization of sanctions is an important step to make traffic safer in the capital. He explained that the change is part of a cooperation with Detran-RS, initiated in April, aimed at making actions faster and more effective.
“Speed is one of the main risk factors identified in traffic accidents resulting in death in Porto Alegre. With the change, EPTC now has the competency to directly initiate suspension processes without needing prior referral to Detran,” declared Bisch Neto to the local press.
In practice, EPTC can now apply the punishment immediately as soon as the radar identifies the speed excess, making the process more efficient and with a greater educational impact. The measure focuses on dissuading dangerous behaviors and preserving lives on the city’s streets.
The New Law Allows Municipalities to Suspend CNH for Their Own Violations
The change is supported by Law No. 14.071/2020, which modified several points of the Brazilian Traffic Code and has been in effect since April 2021. Among the modifications is the transfer of competence to municipalities and road executive bodies to conduct the process of CNH suspension in cases where they themselves issue the violation.
Porto Alegre is one of the first Brazilian capitals to implement the measure with this level of autonomy, which signals a national trend towards decentralization of traffic enforcement. More cities are expected to follow this path soon, according to technicians from Denatran interviewed by Agência Brasil.
Radar, Fine, and Suspension: How It Works in Practice?
When caught by a fixed or mobile radar for speeding more than 50% over the limit, the driver receives a notification of enforcement based on article 218, item III. Subsequently, the process of CNH suspension is opened by EPTC, and the offender has the right to present a defense. If the appeal is denied, the license will be suspended for the time prescribed by law, usually between 2 and 8 months, which can reach up to 18 months in case of recurrence.
The fine for this type of infraction is heavy: R$ 880.41, and 7 points are applied to the license. According to the official Federal Government portal on traffic, this is one of the most severe sanctions in the current system.
Additionally, anyone who has their CNH suspended must undergo a recycling course before being able to drive again, which involves time, money, and a lot of headaches.
Why Is This Happening Now?
The tightening of rules in Porto Alegre is not by chance. Data from EPTC itself show that excessive speed is among the main causes of fatal accidents in the city. In 2023, according to a survey released by the City Hall, over 30% of fatal accidents were directly linked to disrespecting the speed limit.
The idea is that by making the punishment process faster and more visible, drivers will feel the weight of the penalty shortly after committing the infraction, which tends to reduce recidivism and save lives.
