Government Changes the Rule of Continued Benefit. Bolsa Família Now Counts as Part of Per Capita Income and Limit of ¼ Minimum Wage (R$ 379.50) Remains in Effect. Understand with Examples.

The Decree 12.534/2025 changed the regulation of the Continued Benefit (BPC/LOAS) and resumed including Bolsa Família in the calculation of per capita family income. The measure revoked a provision of Decree 6.214/2007 that excluded cash transfers from this calculation.

The economic limit of the BPC remains: income per person in the family group equal to or less than ¼ of the minimum wage. With the minimum of R$ 1,518 in 2025, the income ceiling per person is R$ 379.50.

The new decree also restricts deductions: the gross family monthly income now becomes the sum of incomes “forbidden deductions not provided for” in the norm, reducing loopholes for subtracting amounts. In practice, the economic filter becomes more stringent.

Who is Entitled to BPC and Which Rules Remain in Effect

The BPC is guaranteed to elderly individuals aged 65 or older and people with disabilities who prove an income per person up to ¼ of the minimum wage. It is mandatory to be registered in CadÚnico and keep the registration updated. The benefit amounts to one minimum wage and does not pay a 13th salary.

To calculate income, gross earnings of family members counted for the BPC (same ceiling) are divided by the number of members. INSS details family composition and provides guidance on documents and steps for the application in Meu INSS and CRAS.

The official INSS guide lists health expenses of the elderly or disabled person that can be deducted when expected and proven (e.g., medications not provided by SUS, diapers, special food). Attention: deductions outside what is provided do not count after the new decree.

With the revocation of the clause that excluded cash transfer programs, Bolsa Família amounts now count towards the family income to meet the requirement of R$ 379.50 per person. Offices and technical entities have indicated a higher risk of administrative rejections.

Public bodies register the normative change in the Official Gazette and in legislative repositories. The text also modifies rules in CadÚnico by altering Decree 11.016/2022.

There is a legal debate: a recent ruling from the Federal Court of the 3rd Region deemed the inclusion of Bolsa Família in income for a concrete case as unjustified, overstepping regulatory powers, signaling a potential for judicialization. The outcome may vary by case until eventual standardization.

How to Calculate BPC Per Capita Income in 2025: Practical Examples

Legal Parameter: ¼ of the minimum wage in 2025 (R$ 1,518) = R$ 379.50 per person.

Example 1 — Family of 3 People with Bolsa Família and No Other Income
Composition: grandmother aged 65 (claimant), unemployed daughter, and grandson. Bolsa Família: R$ 600.
Calculation: total income R$ 600 ÷ 3 = R$ 200 per person. Below R$ 379.50. Tends to meet the economic criterion.

Example 2 — Family of 4 People with Bolsa Família and Work Income
Composition: person with disability (claimant), mother, father, and sister. Father receives R$ 1,200; Bolsa Família: R$ 600.
Calculation with the new rule: (1,200 + 600) R$ 1,800 ÷ 4 = R$ 450 per person. Above R$ 379.50 → may be denied.
As it was before, not counting Bolsa Família: 1,200 ÷ 4 = R$ 300 per person → would meet the criterion. This is the direct impact of the decree.

Example 3 — Single-Person Household Receiving Bolsa Família
Composition: adult with disability living alone. Bolsa Família: R$ 600.
Calculation: R$ 600 ÷ 1 = R$ 600 per person. Above R$ 379.50 → may be denied, except for deductions provided in the norm and proven (e.g., health expenses).

Important Observations

  1. Those in CadÚnico must keep data updated.
  2. BPC already received by another member may not count towards income for a new request, according to specific INSS rules.
  3. Medical expenses only count as deductions when provided for and proven; deductions outside the text do not count.

Who May Be Most Affected and What to Do in Case of Denial

Profiles with Bolsa Família and work income near the limit tend to be more affected, as the sum exceeds R$ 379.50 per person. Single-person households and those with seasonal income are also more exposed after the deduction restrictions.

In case of denial, it is possible to appeal administratively and provide proof of health expenses outlined in the INSS guide. If the negative persists, some families have sought legal action, where there has already been a ruling distancing the inclusion of Bolsa Família in income in a specific case. Specialized legal guidance can be decisive.
