Supermarkets and commercial establishments in Marília, in the interior of São Paulo, have new obligations related to the provision of packaging for transporting goods.
The change results from the approval by the City Council and the sanction of Mayor Vinícius Camarinha of the substitute for Bill No. 126/2025, which alters the rules of the local legislation known as the “Bag Law.”
The rule prohibits charging for ecological bags when no other free alternative is available to the consumer.

Change At The Supermarket Checkouts In Marília
In practice, the change alters the dynamic at supermarket checkouts and local businesses.
From the date the law takes effect, consumers cannot be forced to pay for ecological bags if the establishment does not provide a free alternative, such as cardboard boxes or other suitable means of packaging.
The legislation does not prevent customers from bringing their own bags nor does it eliminate the possibility of businesses offering reusable packaging for sale.
The main point is that, according to the approved text, there must be at least one free option to carry purchased products.
This interpretation is included in the institutional disclosure materials about the law and was one of the key issues discussed during the project’s review in the municipal legislature, according to records from the City Council.
Which Bags Are Considered Ecological By The Law

The municipal rule specifically refers to so-called ecological bags, a category that includes biodegradable, recyclable, or reusable models.
The stated aim of the legislation is to maintain existing environmental guidelines in the municipality while redefining the relationship between the cost and availability of these bags in commerce.
During the discussion of the project, examples of bags produced with recycled materials or with technical characteristics that distinguish them from conventional plastic bags were mentioned, whose use is already restricted in Marília by previous legislation.
The law does not detail specific brands or models.
Only general criteria are established, leaving it to municipal enforcement to evaluate whether the offered items meet legal requirements.
Fines Foreseen For Those Who Fail To Comply With The New Rule
The approved text foresees an initial fine equivalent to 130 UFESPs in case of non-compliance.
The value of the UFESP is updated annually by the state government, which causes the amount in reais to vary depending on the period of application of the penalty.
In public references from 2025, this amount corresponded to R$ 4,812.60.
In cases of repeat offenses, the legislation allows for progressively increasing penalties.
In addition to the fine, the set of municipal regulations allows for the adoption of other administrative sanctions, such as seizure of goods and closure of the establishment, according to enforcement criteria.
According to information released by the local government, the amounts collected from environmental fines are earmarked for municipal funds aimed at preservation and sustainability actions.
Amendments To The Bag Law And Local Context

Marília already had specific rules to restrict the distribution of conventional plastic bags and encourage the use of alternatives considered less harmful to the environment.
In 2025, the city hall announced the implementation of adjustments to this legislation, with an initial period of guidance for businesses and educational campaigns conducted by agencies such as Procon.
Bill No. 126/2025 arose in this context as an attempt to clarify points that generated recurring doubts among consumers and merchants.

In such cases, the guiding action of regulatory and consumer protection agencies can be decisive.
