The Government Begins Discussing the End of the Mandatory Payment of Annual Fees for Professionals Who Are Part of Existing Professional Councils in Brazil, They Understand That This Charge Is Similar to the Union Tax, Therefore, Illegal
A legislative proposal to abolish the annual fee of all professional councils was presented in the Senate on January 26, 2019, and today (06) endorsed by Federal Deputy Joice Hasselmann on social media. Citing some examples: Brazilian Bar Association (OAB) and professional councils, such as the Regional Council of Engineering and Agronomy (Crea) and the Council of Architecture and Urbanism (CAU), among many others, we will list all of them at the end of this article.
According to the project, the annual payment is similar to how the union tax was collected, which was abolished in the last Labor Reform.

There are many complaints from Brazilians who are prevented from working in their fields due to high fees they cannot afford.
“The mandatory payment of annual fees for regulatory bodies like CREA, CAU, OAB, among others, only burdens the professional and does not contribute at all to the development of the profession. The idea is that the payment of the annual fee should be optional, not extending to other types of services like collecting ART, in the case of engineers,” via publication on the Senate’s website, which is open for voting by all professionals from these councils.( ⇐ Access if you want to vote against or in favor)
Making an analogy with DETRAN, which issues a license to drive or pilot vehicles, regardless of whether the citizen has practical skills or not, professional councils operate in the same way. You are considered qualified to exercise a specific profession when you prove you have completed a course recognized by MEC and properly registered. Another important role of professional councils is overseeing activities inherent to the professional’s area of expertise, for example: overseeing a construction project to verify if it was executed by a qualified professional and if the ethical standards are being followed.
